On May 15, 2003, Hai Phong City People's Committee issued Decision No. 1019/QD-UB to lease 41 hectares of land to the Vietnam Chamber of Commerce and Industry (VCCI) and temporarily manage 10.7 hectares of land in Tan Thanh commune, Kien Thuy district (now Tan Thanh ward, Duong Kinh district) to implement the Do Son entertainment area project.
The Department of Land Administration and Housing (now the Department of Natural Resources and Environment) and local authorities organized the handover of land in the field to VCCI on May 27, 2003; signed Land Lease Contract No. 49/HD-TD dated July 8, 2003 with VCCI but did not issue a land use right certificate because the financial obligations for the land users had not been determined.
During the process of being leased land by the People's Committee of Hai Phong City to implement the Do Son entertainment area project, VCCI directed the International Trade Investment Company (a company under VCCI) to join forces with Construction Company No. 1 - Hanoi Construction Corporation to establish a new legal entity, Construction - Trade - Tourism Investment and Development Joint Stock Company (Van Xuan Urban Investment and Development Joint Stock Company) to implement the Tan Thanh urban residential area construction investment project.
Although the land use purpose was changed and the project was changed from an entertainment area project to an urban area project, the investor has not yet put the land into use but has only leveled the ground and built a fence system for the land.
On November 17, 2008, Hai Phong City People's Committee issued Decision No. 1942/QD-UBND, deciding to reclaim the above land area to hand over to the Land Fund Development Center (under the Department of Natural Resources and Environment of Hai Phong City) for management.
After that, the Department of Natural Resources and Environment presided over the Departments of Construction, Planning and Investment, Duong Kinh District People's Committee, and Tan Thanh Ward People's Committee to inspect the project implementation and land use of VCCI. The agencies agreed that since the land lease, VCCI has not put the land into use for the leased purpose (more than 5 years since the land handover date on May 27, 2003). According to Decision No. 0618/PTM dated March 22, 2002 of VCCI, Phase I was implemented within 1.5 years after the investment report was approved; violating Clause 12, Article 38 of the Land Law.
On November 17, 2008, Hai Phong City People's Committee issued Decision No. 1942/QD-UBND on land recovery of VCCI (now Vietnam Federation of Commerce and Industry).
However, in the process of land recovery according to the decision of the City People's Committee, many proposals have arisen from Van Xuan Urban Development and Investment Joint Stock Company.
After receiving the petitions, the City People's Committee issued Document No. 1782/VP-DC2 dated March 19, 2024 to the Vietnam Federation of Commerce and Industry and Van Xuan Urban Development Investment Joint Stock Company regarding the exchange of content related to petitions and complaints of Van Xuan Urban Development Investment Joint Stock Company.
However, the Vietnam Federation of Commerce and Industry issued Document No. 2553/LDTM-VP dated November 30, 2023 and Document No. 2579/LDTM-VP dated December 5, 2023 requesting to postpone the meeting on the grounds that the leaders had a work schedule and could not attend the meeting to propagate and mobilize the land handover according to the invitation of the People's Committee of Duong Kinh district.
Although the authorities have promoted and mobilized the Vietnam Federation of Commerce and Industry to comply with the handover of the site according to Decision No. 1942/QD-UBND on land recovery, up to now, the Vietnam Federation of Commerce and Industry has not yet complied with the move of all assets and handover of the land to the Land Fund Development Center for management.
According to the leader of the People's Committee of Duong Kinh District, the district has recently carried out procedures for compulsory land recovery to implement the land recovery decision of the City People's Committee. However, up to now, the Vietnam Federation of Commerce and Industry still has documents related to the subject that must carry out compulsory land recovery.
The People's Committee of Duong Kinh District will develop a plan for enforcement after receiving opinions from the Standing Committee of the City Party Committee and the City People's Committee regarding the abandoned project for many years to recover and manage the above area, avoiding waste of land resources.
