From January 1, 2025, the Law on Road Traffic Order and Safety will come into effect. Notably, the driving license will have 12 points and when violating, points will be deducted depending on the nature and severity of the violation of the law on road traffic order and safety.
Driver's license point deduction data will be updated
Specifically, Clause 1, Article 58 of the Law on Road Traffic Order and Safety stipulates: The number of points deducted for each violation depends on the nature and severity of the violation. Data on the driving license deduction points of the violator will be updated into the database system immediately after the penalty decision comes into effect and the person whose driving license points are deducted will be notified.
Thus, depending on each specific violation, there will be a corresponding deduction of points from the driver's license.
The Government is currently assigning the Ministry of Public Security to draft a Decree regulating administrative sanctions for violations of traffic order and safety in the field of road traffic; deducting and restoring points from driving licenses, which stipulates specific points deducted for each violation.
Driver's license point deduction data will also be continuously updated to the traffic order and safety management database system, to ensure unified and synchronous management for each driver granted a driver's license.
Violators will also be notified of the number of points deducted as well as their remaining points, so they can know whether they are qualified to drive a vehicle in traffic or not.
Must take test to recover points
Clause 2, Article 58 of the 2024 Law on Road Traffic Order and Safety stipulates that a driving license that has not had all points deducted and has not had points deducted within 12 months from the date of the most recent point deduction will have all 12 points restored.
If a driver has had his or her driving license demerit points reduced but has not yet reached 12 points, and has not committed any driving offenses for which his or her driving license demerit points have been deducted in the next 12 months, the full 12 points will be restored.
In cases where a driver has had all 12 points deducted, the driver's license holder is not allowed to drive a vehicle on the road under that driver's license.
After at least 6 months from the date of deduction of all points, the driver's license holder is allowed to participate in the test on legal knowledge on road traffic order and safety as prescribed in Clause 7, Article 61 of this Law organized by the traffic police force. If the result is satisfactory, the full 12 points will be restored.
Regarding the restoration of driving license points, the Ministry of Public Security issued Circular 65/2024 dated November 12 regulating the testing of legal knowledge on road traffic order and safety to restore driving license points.
To be able to drive a vehicle on the road with a driving license that has had all points deducted, after 6 months from the date of deduction of points, the driver needs to participate in the test on legal knowledge of road traffic order and safety organized by the traffic police force. If the result is satisfactory, the full 12 points will be restored.
After being changed, reissued or upgraded, the driving license will retain the same number of points as the driving license before being changed, reissued or upgraded. The full 12 points will not be restored in cases where points have been deducted.
