How can a driver who has lost all his driving license points get them back?

After at least 6 months from the date of deduction of all driving license points, the driver will have to take a road traffic safety law knowledge test. The test is organized by the traffic police, and if the results are satisfactory, the 12 points will be restored.


On December 19, the Ministry of Public Security said that the Government is assigning this agency to draft a decree regulating administrative sanctions for violations of traffic order and safety; deducting and restoring points on driving licenses, in which specific points are deducted for each violation.

From January 1, 2025, traffic police will implement the regulation of deducting driving license points for violators.

According to Article 58 of the Road Traffic Safety Law 2024 (coming into effect from January 1, 2025), the number of points deducted for each violation depends on the nature and severity of the violation. Data on the points deducted by the violator will be updated into the database system immediately after the penalty decision takes effect, and the person whose points are deducted will be notified.

Clause 2, Article 58 of this Law states that for a driver's license that has not been deducted all points and has not been deducted points within 12 months from the date of the most recent deduction, the driver will have all 12 points restored.

For cases where drivers have had all 12 points deducted, according to Clause 2, Article 58 of the Law on Traffic Safety, people with driving licenses are not allowed to drive vehicles on the road with that license class.

After at least 6 months from the date of deduction of all points, the driver will be allowed to participate in the test on knowledge of road traffic safety laws as prescribed in Clause 7, Article 61 of this Law. The test will be organized by the traffic police force and the results must be satisfactory before the full 12 points will be restored.

Currently, the Ministry of Public Security has issued Circular 65/2024/TT-BCA dated November 12, 2024 regulating the testing of legal knowledge on road traffic order and safety to restore driving license points, effective from January 1, 2025.

After being changed, reissued or upgraded, the driving license will retain the same number of points as before changing, reissuing or upgrading. The full 12 points will not be restored in cases where points have been deducted.

If all 12 points are deducted, the driver's license holder will have to take a traffic safety knowledge test.

The previous draft decree of the Ministry of Public Security proposed 189 behaviors and groups of behaviors that would result in points being deducted. Of these, 28 behaviors and groups of behaviors would result in a deduction of 12 points (the total points of the driving license).

Specifically, the acts that result in a 12-point deduction include: Driving with an alcohol concentration exceeding 80 milligrams/100 milliliters of blood or exceeding 0.4 milligrams/1 liter of breath; failing to comply with the request of an officer on duty to check alcohol concentration.

Driving a vehicle while having drugs in the body; failing to comply with a request for drug testing by a law enforcement officer; driving a vehicle carrying goods exceeding the vehicle's permitted weight by more than 150%; illegally racing, weaving, or swerving; speeding by more than 35km/h; speeding while chasing on the road; using the feet to control the steering wheel while the vehicle is running on the road.

According to the Drafting Committee, these are intentional, dangerous violations with a high risk of causing traffic accidents and destroying traffic works.

The proposed behaviors that will result in a 10-point deduction from a driver's license include: Driving on the road with a blood or breath alcohol concentration exceeding 50 milligrams to 80 milligrams/100 milliliters of blood or exceeding 0.25 milligrams to 0.4 milligrams/1 liter of breath...

Violations proposed to have 6 driving license points deducted include: Failure to comply with traffic light signals; failure to comply with signals or instructions of traffic controllers or traffic inspectors.

Driving in the wrong direction on the highway, reversing on the highway, except for priority vehicles on emergency missions as prescribed; causing a traffic accident without stopping, not preserving the scene, fleeing, not reporting to the competent authority, not participating in first aid for the victim.
