What knowledge do drivers have to "retake"?

Decree No. 168/2024 regulating administrative sanctions for violations in the field of road traffic, deduction of points, and restoration of driving license points (GPLX) effective from January 1, 2025 has replaced Decree 100/2020/ND-CP (amended and supplemented by Decree 123/ND-CP).

Each driving license class has 12 points according to new regulations applied from 2025.

Compared to previous regulations, Decree No. 168/2024 applies for the first time the deduction of driving license points for traffic violators.

According to the new regulations, each type of driver's license has 12 points. Drivers who violate traffic laws will have a minimum of 2 points and a maximum of 10 points deducted, depending on the nature of the violation.

Since January 1st, there have been many drivers who violated traffic laws, were fined and had their driving license points deducted.

According to the representative of the Traffic Police Department, a driver's license that has not been deducted all points and has not been deducted points within 12 months from the date of the most recent deduction will have all 12 points restored. If a driver's license has been deducted all points, the driver will not be allowed to drive a vehicle under that license.

After at least 6 months from the date of all points being deducted, the driver's license holder is allowed to participate in the test on knowledge of road traffic safety laws, organized by the Traffic Police, and if the result is satisfactory, all 12 points will be restored.

To have their driving license points restored, drivers will follow the regulations in Circular No. 65/2024 (effective from January 1, 2025) regulating the testing of legal knowledge on traffic safety order.

Specifically, the test content for drivers includes: Theoretical knowledge of laws on road traffic safety based on theoretical test questions to issue driving licenses; simulations of traffic situations on computers as prescribed by the Ministry of Transport.

During the theory test, the test taker takes the test on the computer using the software. For the simulation knowledge test, the candidate handles traffic situations according to the simulation on the computer.

Regarding the time, structure of the test and the satisfactory results, Circular No. 65/2024 divides according to the driving license classes. For example, test takers with driving licenses of class A, A1 and B1 will take the test in 19 minutes. The test structure consists of 25 multiple-choice questions, each question is worth 1 point, of which 1 question is considered a failing score.

People with a Class B driving license take the test in 20 minutes, including 30 multiple choice questions, each question is worth 1 point, of which 1 question is considered a failing point.

For the situation simulation test, Circular 65 stipulates that the test time is no more than 10 minutes, including 10 questions simulating traffic situations corresponding to 10 points. Each question has a maximum score of 5 points and a minimum score of 0 points.

The score achieved by the test taker corresponds to the time of recognizing and identifying a potentially unsafe traffic situation through interaction with a computer with simulation software installed. Test takers who score 35/50 points or more are considered to pass.

In addition, those who fail the theoretical legal knowledge test will not be allowed to take the simulated legal knowledge test. Those who pass the theoretical test but fail the simulated test will have their theoretical test results reserved for 1 year from the date of the test.

Notably, test takers whose test results do not meet the requirements can re-register for the test after 7 working days from the date of completion of the previous test.

If all 12 points are deducted, the driver's license holder will have to take a traffic safety knowledge test.

How do traffic police test knowledge?

Circular No. 65 also stipulates the competent authority to test legal knowledge on traffic safety and order, including the Traffic Police Department and the Traffic Police Department of the provincial and centrally-run city police.

To implement this, these units will arrange knowledge testing rooms, equip computers connected to the WAN network of the Ministry of Public Security to the server located at the Traffic Police Department and testing software.

The "exam rooms" also have cameras that monitor all images in the room, and have devices that store camera image data.

Officers assigned to test knowledge must have a Class A motorcycle license and a car license, and be trained by the Traffic Police Department and issued an examiner card.

A representative of the Traffic Police Department added that the regulation on deducting driving license points is both a deterrent and an educational and motivational measure to comply with laws on road traffic safety and order.

"Each time a point is deducted, it is like a "bell" warning drivers to comply with the law better. If the driver's license has not been deducted all points, the driver can continue to drive the vehicle on the road, without affecting traffic activities, production and business activities, or people's lives.
