Submit to the National Assembly a pilot special mechanism to develop urban railway networks in Hanoi and Ho Chi Minh City.

On the afternoon of February 13, continuing the program of the 9th Extraordinary Session, the National Assembly listened to the Presentation and Verification Report on the draft Resolution on piloting a number of specific and special mechanisms and policies to develop the urban railway network system in Hanoi and Ho Chi Minh City.


Presenting the Report, Minister of Transport Tran Hong Minh said that the development of the National Assembly Resolution aims to mobilize all legal resources, shorten the implementation progress as much as possible, effectively exploit land resources; strongly decentralize and delegate power to the two cities in implementing investment, promote the initiative and positivity of the two cities; realize the Resolutions and Conclusions of the Central Executive Committee and the Politburo.

The development of the Resolution ensures the following viewpoints: consistent with the Constitution, not contrary to international treaties; consistent with the strategies, resolutions, and conclusions of the Central Executive Committee and the Politburo; simplifies procedures, based on the viewpoint of the Central Committee building and promulgating mechanisms and policies, ensuring macro-control, promoting decentralization, shortening procedures so that "localities decide, localities do, localities take responsibility"; maximizing resource mobilization, creating favorable conditions for the two cities to successfully implement the goal of developing a modern and sustainable urban railway system.

According to the Minister of Transport, the draft Resolution consists of 11 Articles, specifically: Article 1 on the scope of regulation; Article 2 on the subjects of application; Article 3 on the interpretation of terms; Article 4 on capital mobilization; Article 5 on the order and procedures for investment implementation; Article 6 on urban development according to the TOD model; Article 7 on railway industry development, technology transfer and human resource training; Article 8 on policies on construction materials and dumping sites; Article 9 on regulations specifically applicable to Ho Chi Minh City; Article 10 on implementation organization; Article 11 on enforcement provisions.

The Draft Resolution standardizes 6 specific and special policy groups in the Resolution proposal dossier approved by the competent authority, including the policy group on: capital mobilization; investment implementation procedures; urban development according to the TOD model; railway industry development, technology transfer and human resource training; construction material and dumping site policies; regulations specifically applicable to Ho Chi Minh City.

Examining the above issue, Chairman of the National Assembly's Economic Committee Vu Hong Thanh said that, regarding the establishment of total investment and draft bidding package (Clause 6, Article 5 of the draft Resolution), the Economic Committee found that the draft Resolution identifies two types of projects: urban railway projects and urban railway projects according to the TOD model.

Accordingly, at point a, the type of project to which the policy applies is defined as urban railway projects and urban railway projects following the TOD model, however, at points b and c, it is only defined as projects. On the other hand, the North-South high-speed railway project only allows this policy to be applied to railway projects, not including projects in the TOD area. Therefore, it is requested to explain and clarify.

Regarding Clause 7, Article 5 of the draft Resolution stipulating that urban railway projects and urban railway projects under the TOD model are assigned to contractors to shorten the implementation time of the projects, Mr. Thanh informed that the Economic Committee believes that the assignment of contractors for urban railway project packages is appropriate, due to the special nature of the need to speed up the progress of this type of project. However, for urban railway projects under the TOD model, it is recommended to consider the assignment of contractors to ensure competitiveness, transparency and efficiency in the exploitation and development of TOD areas.

Regarding the regulations specifically applicable to Ho Chi Minh City (Article 9), the Economic Committee found that these regulations are basically inherited from the Law on the Capital, so the Government's proposal is well-founded. However, Clause 4, Article 9 of the draft Resolution stipulates that "The City People's Committee is allowed to organize bidding to select investors for projects using land to develop urban areas in the direction of public transport development according to separate urban design projects, urban planning projects in the vicinity of stations on urban railway lines approved by competent authorities" is not consistent with the regulations on urban railway projects, urban railway projects according to the TOD model in Article 3 of the draft Resolution. In addition, Clause 26, Article 79 of the Land Law stipulates cases of land recovery for socio-economic development for national and public interests, including projects in the vicinity of traffic connection points and traffic routes with development potential, to serve as a basis for the city to implement urban renovation projects. Therefore, the above regulation is unnecessary.
