Must design a mechanism to exempt policy implementers from liability

According to the Prime Minister, the current draft Resolution exempts the drafter from liability in case of risks. It is necessary to design an additional mechanism to exempt the implementer from liability.


On February 15, the National Assembly discussed in groups the draft Resolution of the National Assembly to pilot a number of policies to remove obstacles in science, technology and innovation activities.

Speaking at the meeting, Prime Minister Pham Minh Chinh said that, implementing the direction of the Politburo and the General Secretary, the Government has made the most of the time, the National Assembly Standing Committee and relevant agencies of the National Assembly have been very active in completing the draft Resolution to submit to the National Assembly.

The Prime Minister emphasized that rapid and sustainable development based on science and technology, innovation, and digital transformation is an objective requirement. Therefore, institutional dismantling needs to be focused on.

The Prime Minister informed that the Government is directing the amendment of a series of laws, but in order for Resolution 57-NQ/TW to come into effect immediately, we must present and discuss the draft Resolution today. The draft Resolution focuses on removing obstacles that are currently very necessary to implement Resolution 57-NQ/TW, but it is not comprehensive and must continue to amend other laws.

According to the Prime Minister, the draft Resolution needs to add some special mechanisms, not specific ones, only then can it be done and truly innovated. Accordingly, first, there needs to be a special mechanism for developing science and technology infrastructure, innovation and digital transformation. This infrastructure is currently very weak while the resources needed are very large, so there must be a mechanism to mobilize these resources from people, businesses and society for development.

The second is a special mechanism for management such as public leadership - private administration, public investment - private management, private investment - public use in science and technology activities. For example, public investment - private management, investment in state technology infrastructure but handing over to private management.

Third is a special mechanism for scientists and scientific works that can be commercialized. It is necessary to decentralize and delegate power to provinces, cities, ministries, branches and even related entities, eliminate requests and grants, reduce administrative procedures and manage overall efficiency.

Fourth, the current draft Resolution exempts the drafter from liability when risks occur, but does not mention the implementer. Meanwhile, implementation is difficult. If there is no special mechanism to protect the implementer, they will be afraid of liability, leave it there, or do not want to do it because they are not protected. It is necessary to design an additional mechanism to exempt the implementer from liability, not just the policy designer, to be comprehensive.

Fifth is a special mechanism to attract human resources to develop private enterprises in science and technology; attract human resources from outside so that they can return to Vietnam to promote the development of science and technology through policies on taxes, fees, charges, housing, land, visas, and labor contracts.

The Prime Minister also said that it is necessary to further study these issues and hopes that the National Assembly Standing Committee will support them. Of course, if there is a special mechanism, it is necessary to design special management tools to avoid violations and improve efficiency, and to avoid corruption, negativity, and waste.

Speaking at the meeting, Politburo member and Permanent Deputy Prime Minister Nguyen Hoa Binh also said that on December 22, 2024, the Politburo issued Resolution No. 57/NQ-TW on breakthroughs in science, technology, innovation and national digital transformation. The task is to effectively implement the Resolution, and to do so, it must be legalized and institutionalized for widespread and effective implementation in practice and real life.

According to the Deputy Prime Minister, this legalization and concretization process will be divided into two steps. The first step is to develop a National Assembly Resolution to pilot a number of policies to remove obstacles in science, technology and innovation activities. The second, more fundamental step is to amend many related laws to remove obstacles for science and technology development in the spirit of considering the whole picture, discussing in a more fundamental, methodical and strategic manner.

"The draft Resolution of the National Assembly has piloted a number of policies to remove obstacles in science, technology and innovation activities, including two major areas: science and technology and digital transformation," said the Deputy Prime Minister.
