Proposing 6 groups of specific mechanisms and policies for developing urban railway networks

Kinhtedothi-At the working session on the afternoon of February 13, the Government submitted to the National Assembly for consideration the draft resolution of the National Assembly to pilot a number of specific and special mechanisms and policies to develop the urban railway network system in Hanoi and Ho Chi Minh City with 6 groups.


Solving institutional "bottlenecks"

Presenting the draft resolution of the National Assembly on piloting a number of specific mechanisms and policies to develop the urban railway network in Hanoi and Ho Chi Minh City, Minister of Transport Tran Hong Minh emphasized: Urban railway is the "backbone" of the urban public transport system. Investing in the development of urban railway is an objective necessity, an important and fundamental solution to develop modern and sustainable urban areas, associated with environmental protection and climate change response.

The Project on Developing the Urban Railway Network has been approved by the Politburo, and the Ministry of Transport has developed specific policies, especially to resolve institutional "bottlenecks", contributing to the goal of completing the urban railway network in the two cities.

Accordingly, the Draft Resolution consists of 11 articles, standardizing 6 groups of specific and special policies including: capital mobilization; investment implementation procedures; urban development according to the TOD model; railway industry development, technology transfer and human resource training; construction materials and waste disposal policies...

In which, the group of policies on capital mobilization with the mechanism of the Prime Minister being able to decide on the arrangement of the annual medium-term public investment plan for localities; using the source of increased revenue, annual savings of the central budget and other legal sources without having to follow the order of priority. Mobilizing ODA capital, preferential loans without having to make a proposal.

The City People's Council is responsible for arranging the medium-term public investment plan, annual local budget capital, increased revenue sources, expenditure savings, and other legal capital sources; the project is also allocated capital over many medium-term periods. The City People's Committee is allocated capital to deploy in advance some tasks serving the project (investment preparation, site clearance, etc.).

With the group of policies on investment procedures and processes, urban railway projects will not have to establish or appraise investment policy decisions, but will be able to immediately carry out the procedures for establishing, appraising and deciding on investment.

The City People's Committee is allowed to decide on dividing the project into component projects and sub-projects; extending the implementation period without increasing the total investment; appointing contractors for consulting, construction and installation packages and investors, and receiving advance budget...

To develop urban areas according to the TOD model, the Draft Resolution allows when establishing and adjusting TOD planning to decide on criteria different from the standards to exploit land funds and added value from land. The City People's Committee is allowed to decide on the transfer of land use planning criteria in the TOD area...

For Ho Chi Minh City, the Draft Resolution provides specific regulations, which are that the city is allowed to collect and use money collected in the TOD area; mobilize capital through loans issued by local government bonds; organize bidding to select investors using land for urban development and improvement...

Clarifying types of urban railway projects according to the TOD model

Examining this content, Chairman of the National Assembly's Economic Committee Vu Hong Thanh expressed agreement with the necessity of issuing a resolution and agreed with the Government's proposal on 6 specific and special groups of books in the Draft Law.

For some specific policies, the Economic Committee recommends that the drafting agency clarify further on capital mobilization at Point a, Clause 1, Article 4 of the Draft Law.

"In case of reducing or adding more projects compared to the project list appendix attached to this resolution, how will the additional central budget capital with a target for local budgets to implement the project be determined to avoid legal gaps in the process of deployment and implementation?" - The Chairman of the Economic Committee clearly stated.

Regarding investment procedures, the Economic Committee recommends clarifying the types of urban railway projects and urban railway projects following the TOD model; projects with designated bidding to shorten implementation time are appropriate, but it is necessary to consider implementing the designated bidding to ensure competitiveness, transparency and efficiency; it is necessary to review and make appropriate adjustments to the TOD model, the necessity to avoid overlaps and conflicts.

Regarding the regulations specifically applicable to Ho Chi Minh City (Article 9 of the Draft Law), the Economic Committee found that these regulations are basically inherited from the Capital Law, so the Government's proposal is well-founded. However, the Economic Committee believes that the regulation allowing the city to bid to select investors is not consistent with the regulations on urban railway projects and urban railway projects following the TOD model.

Along with that, the Land Law has stipulated cases of land recovery for socio-economic development for national and public interests, including projects in the vicinity of traffic connection points and traffic routes with development potential, to serve as a basis for the city to implement urban renovation projects. Therefore, the above regulation is unnecessary.
