Kinhtedothi - The Hanoi Department of Natural Resources and Environment has just issued a document announcing the implementation of land use extension procedures according to the 2024 Land Law to meet practical requirements.
According to the Hanoi Department of Natural Resources and Environment, the 2024 Land Law, Decree No. 102/2024/ND-CP dated July 30, 2024 of the Government detailing the implementation of a number of articles of the Land Law (effective from August 1, 2024), in which Clause 18, Article 3, Clause 3, Article 172, Land Law 2024 and Clause 5, Article 112 of Decree No. 102/2024/ND-CP of the Government stipulate the implementation of land use extension procedures as follows:
Land use extension is the act of a competent State agency allowing continued use of land after the expiry of the term for the current purpose of use as prescribed by the Land Law. Land use extension is carried out in the final year of the land use term, except for the case specified in Point a, Clause 1, Article 172 of the Land Law. Land users who wish to extend land use must submit an application for extension at least 6 months before the expiry of the land use term. If the land user fails to submit an application for extension within the deadline for submitting the application for extension, the land use shall not be extended, except in cases of force majeure. In case the land use term is not extended, the competent State agency shall reclaim the land in accordance with the provisions of the Land Law.
In case the land use term expires but by the effective date of Decree No. 102/2024/ND-CP the competent State agency has not yet reclaimed the land, the land user is allowed to carry out procedures to extend the land use term within 6 months from the effective date of this Decree. After this term (on February 1, 2025) if the land user does not carry out procedures to extend the land use term, the State will reclaim the land, except in cases of force majeure.
In order to promptly implement the 2024 Land Law and Decree No. 102/2024/ND-CP dated July 30, 2024 of the Government, ensuring the rights and obligations of land users, the Hanoi Department of Natural Resources and Environment requests that organizations, households and individuals whose land use term has expired or whose remaining land use term is ≤ 1 year, urgently contact the Department (for organizations) or contact the Department of Natural Resources and Environment of the district, town or city where the land is located (for households and individuals) for consideration and extension of the land use term according to regulations.
In addition, the Hanoi Department of Natural Resources and Environment also requested the Department of Planning and Investment to review investment projects using land that have expired or are about to expire to carry out procedures to adjust or extend the operation period of the investment project in accordance with the provisions of the investment law. Notify the Department of Natural Resources and Environment of cases that are not eligible to adjust or extend the operation period of the investment project to coordinate and implement in accordance with the provisions of the 2024 Land Law and the Decrees guiding the implementation of the 2024 Land Law.
