Specifically, the work of developing inter-sectoral coordination regulations in the work of receiving citizens and handling complaints and denunciations about the judiciary has been carried out. In the process of handling complaints and denunciations, the Provincial People's Procuracy proactively coordinated with the agencies conducting the proceedings in receiving, classifying, processing, resolving and supervising the settlement of complaints and denunciations in criminal proceedings. In the process of inspection, the Provincial People's Procuracy applied direct inspection measures to the police investigation agency, issued documents requesting self-inspection and notified the results to the Provincial People's Procuracy. After inspection, timely conclusions and recommendations were issued to overcome limitations, ensuring that the reception, processing and settlement of complaints were carried out promptly, in accordance with legal regulations, and without prolonged backlog.
Judicial branches sign coordination regulations
The People's Procuracy at two levels has coordinated well with judicial agencies in exchanging information, reviewing to ensure consistent data, providing relevant documents and notifying the results of handling complaints and denunciations in judicial activities, ensuring compliance with procedures and time limits as prescribed by law. During the period, judicial agencies have done a good job of sending reports and notifications on the handling of complaints and denunciations in judicial activities to the higher-level sector.
Accordingly, the results of the work of receiving, classifying and processing petitions by the Provincial People's Procuracy were 1,205 petitions; the Provincial Police Investigation Agency received 130 petitions; the Civil Judgment Enforcement Agency received 625 petitions; the Provincial People's Court received 319 petitions. After receiving the petitions, the units also proceeded to resolve them in accordance with their authority. Specifically, through verification and handling by the Provincial People's Procuracy, 94 petitions were resolved (1 correct complaint; 93 incorrect complaints); the Provincial Police Investigation Agency resolved 104 petitions (104 incorrect complaints); the Civil Judgment Enforcement Agency resolved 503 petitions (46 correct complaints; 33 partly correct complaints; 242 incorrect complaints); the Provincial People's Court resolved 293 petitions (7 correct complaints; 286 incorrect complaints)...
Through some of the above practical results of the work, the development and promulgation of 2 joint circulars (Joint Circulars 01 and 02 regulating coordination in the work of handling complaints and denunciations regarding judicial activities) is completely urgent and suitable to the requirements of practice. The content of the 2 joint circulars is consistent with and consistent with the Law on Complaints, the Law on Denunciations and the Criminal Procedure Code. Joint Circular 02 clearly stipulates the scope of regulation, subjects of application, especially 11 forms used in the work of receiving and handling complaints and denunciations in criminal proceedings in accordance with the requirements of practical work. In addition, there are still some shortcomings and limitations in the coordination process. From there, propose necessary solutions to develop, amend and supplement Joint Circular 02 to suit the current situation.
In the coming time, relevant sectors will continue to deploy and disseminate Joint Circular 02/2018 to civil servants. Strengthen the leadership of Party committees and unit leaders in the management, classification, handling and settlement of complaints and denunciations in criminal proceedings, as well as in inter-sectoral coordination in the management, classification, handling and settlement of complaints and denunciations and supervision of the settlement of complaints and denunciations in criminal proceedings. Improve the effectiveness of the settlement of complaints and denunciations, ensuring compliance with legal regulations. Inter-sectoral coordination in inspection and review to ensure consistency, notification and deadline for sending reports and notifications on the settlement of complaints and denunciations in judicial activities..., in order to effectively implement the leadership, management, settlement, reporting and notification of the results of the settlement of complaints in judicial activities of the two-level judicial sectors of An Giang province in the coming time.
