Ensure consistency and uniformity with legal regulations
According to the Vietnam Inland Waterways Administration, after nearly 3 years of implementation, the content of Circular 18 has revealed some shortcomings, is no longer consistent with regulations and management practices; and needs to be amended to ensure consistency and consistency with relevant legal provisions and to be consistent with state management practices on ports, inland waterway wharves, and anchorage areas.

Specifically, the draft amended circular has revised and supplemented the contents on legal basis, scope of management, tasks and powers, and organizational structure of the inland waterway port authority.
Regarding the management scope of the Inland Waterway Port Authority under the Vietnam Inland Waterway Administration, it includes ports, wharves (except for cross-river passenger wharves), and anchorage areas that have been announced and licensed for operation. These include ports, wharves, and anchorage areas in seaport waters assigned by the Ministry of Transport (Point d, Clause 1, Article 3 of the draft), while Circular 18 stipulates "ports, wharves, and anchorage areas in seaport waters connected to national inland waterways".
Inland waterway port authorities under specialized transport agencies (departments) under the People's Committees of provinces and centrally-run cities will manage ports, wharves, and anchorage areas on local inland waterways; Ports, wharves, and anchorage areas on specialized inland waterways connecting to local inland waterways; Ports, wharves, and anchorage areas in seaport waters within the administrative boundaries of localities assigned by the Ministry of Transport; Ports, wharves, and anchorage areas as prescribed in Clause 1, Article 3 of the amended circular are assigned by the Ministry of Transport according to regulations.
The draft circular also proposes to amend and supplement the tasks and powers of the inland waterway port authority as stipulated in Clause 16, Article 4: "Participate in the development of legal documents, strategies, planning, long-term, medium-term and annual development plans; projects, proposals, and works within the scope of specialized state management of inland waterways; planning of inland waterway infrastructure, standards and norms of ports, wharves, and anchorage areas when requested."
Supplementing regulations on port authority to facilitate transportation
Regarding the organizational structure, the draft proposes to stipulate: "The representative of the inland waterway port authority performs specialized state management functions at ports, wharves, and anchorage areas assigned according to regulations, and is allowed to use its own seal. Based on the requirements of the tasks and actual management area, the director of the inland waterway port authority shall organize the inland waterway port authority teams under the representative of the inland waterway port authority accordingly.

The Director of the Vietnam Inland Waterways Administration and the director of the department shall decide to establish, reorganize, and dissolve the representative offices of the inland waterways port authority under their management upon the proposal of the director of the inland waterways port authority.
Explaining this proposal, the Vietnam Inland Waterways Administration said that before Circular 18 was issued, the establishment of a port authority group under the port authority representative had many advantages. For relevant organizations and individuals in the area under the management of the port authority group (vehicle owners, vehicle drivers, port owners, wharfs, relevant agencies and units...), it will greatly reduce the time and travel costs to promptly carry out administrative procedures according to regulations and other related work due to the close distance.
For port authorities, port officials also reduce a lot of time and travel costs to promptly inspect, complete procedures, and issue permits to enter and leave ports and wharves for vehicles according to regulations, serving people and businesses. At the same time, it is convenient to handle and coordinate with agencies and units in the area to promptly handle arising situations according to assigned functions, tasks, and powers.
However, Circular 18 does not stipulate that there are port authority teams under port authority representatives, so inland waterway port authorities and organizations and individuals operating in the inland waterway sector have encountered many difficulties.
"Therefore, it is necessary to organize a port authority team (working point) under the port authority representative to effectively perform assigned tasks and powers and create favorable conditions for organizations and individuals to participate in business activities in the field of inland waterway transport," the Vietnam Inland Waterways Administration recommended.
Currently, the inland waterway port authorities include regional inland waterway port authorities under the Vietnam Inland Waterways Administration and local inland waterway port authorities under the Departments of Transport of provinces and cities.
Regional inland waterway port authorities under the Vietnam Inland Waterways Administration include 5 regional inland waterway port authorities, managing 235 ports and 3,465 wharves scattered over 6,000km of national inland waterways in 30 provinces and cities.
The inland waterway port authorities under the Department of Transport include 16 inland waterway port authorities in the following provinces and cities: Hai Phong City, Quang Ninh, Ba Ria - Vung Tau, Ho Chi Minh City, Dong Nai, Can Tho, Vinh Long, Tay Ninh, Kien Giang, Long An, Dong Thap, Ben Tre, Tien Giang, Da Nang, Ninh Binh.
