Deployed since September, the Provincial People's Council Working Group has conducted direct supervision and reporting at 9 district-level localities, along with 3 specialized departments of the province. The supervision content is "Compliance with legal regulations on handling administrative violations (VPHC) in a number of areas in the province in the period of 2021 - 2023".
Accordingly, the delegation focused on supervising the handling of administrative violations in five areas: land; environment; construction; security, order and social safety; and prevention of social evils.
During the monitoring reporting period, 9 district-level localities issued 1,640 decisions on administrative sanctions for violations of law, with a fine of more than VND 15.23 billion. Meanwhile, 3 specialized departments and branches issued 75 decisions on administrative sanctions for violations of law in the fields of land, construction, and environment, with a fine of VND 4.95 billion; 17,943 decisions on administrative sanctions for violations of law in the fields of security, order, social safety, and social evil prevention, with a fine of more than VND 26.72 billion.
District-level localities have completed the implementation of 1,185 decisions on administrative sanctions by district-level People's Committee Chairmen (accounting for 72%), with the collected amount of nearly VND 10.3 billion. Specialized departments and branches have completed the implementation of 15,854 decisions on administrative sanctions (accounting for 88.4%), with the collected amount of nearly VND 8 billion.
The monitoring delegation assessed that agencies, units and localities have basically implemented the provisions of the law. Most violations were detected and handled promptly, with the right people and actions, within the time limit, meeting the requirements of state management in the province.
The number of decisions that are subject to complaints and lawsuits is very small. The work of detecting and handling administrative violations is basically carried out promptly, objectively, in accordance with the authority, order and procedures prescribed.
Regarding limitations, according to the Monitoring Team, many localities are still confused in applying specialized legal documents; some decisions on sanctioning administrative violations still have errors in form, level of sanction and authority to decide on sanction, causing difficulties in the implementation process. Some cases have prolonged the time leading to the expiration of the statute of limitations for sanctioning administrative violations...
According to the recommendation of the Supervisory Delegation, the Provincial People's Council requested the Provincial People's Committee to step up inspection and examination of compliance with legal regulations on land, construction, environment, security, order, social safety and prevention of social evils.
Especially in localities where many violations of land encroachment, illegal land use conversion, illegal construction, illegal mineral exploitation, discharge of waste into the environment exceeding standards, and illegal dumping occur.
Strengthen the application of information technology, promptly build a provincial database on administrative sanctions to serve the handling work to ensure accuracy and thoroughness...
