Reviewing legal documents, paving the way for development

Prime Minister Pham Minh Chinh, Head of the Steering Committee, said that at the first session a month ago, the Steering Committee identified key tasks and solutions; assigned key tasks that the Ministry of Justice - the Standing Body of the Steering Committee and ministries, branches and localities need to focus on implementing.

In particular, it is required to review and revise contents related to: decentralization, delegation of power; reduction and simplification of administrative procedures; elimination of the request-grant mechanism; anti-harassment, reduction of compliance costs for people and businesses; unblocking and effectively using all resources for development, taking public investment and State resources as the guide and activating all other legal resources for development.

Based on the review, a law amending and supplementing a number of laws with simplified procedures and processes will be developed to handle problems in accordance with the principles. Ministries and branches will preside over and draft laws amending laws under their management, report to the Government for consideration, and submit to the National Assembly at the 8th Session.

According to the Ministry of Justice - the Standing Agency of the Steering Committee, implementing the direction of the Prime Minister, Head of the Steering Committee after the first meeting, 15 ministries, ministerial-level agencies; 55 localities and a number of associations and enterprises have reviewed legal documents. By July 31, 2024, a total of 594 recommendations were compiled within the scope of the content requirements set forth at the first meeting of the Steering Committee.

Including contents in 13 Laws such as: Investment Law; Public Investment Law; Investment Law in the form of public-private partnership; Planning Law and Law amending and supplementing a number of articles of 37 laws related to planning; Enterprise Law; State Budget Law; Tax Management Law; Law on Management and Use of Public Assets; Accounting Law; Independent Auditing Law; Securities Law.

At the second meeting, the Steering Committee reviewed and evaluated the implementation of tasks; principles and guidelines for reviewing legal documents; issues with difficulties, causes and solutions; reviewed and evaluated the current status of document processing after reviewing in the past; proposed specific solutions to speed up the progress and quality of document processing after reviewing.

In particular, the members of the Steering Committee discussed the contents of the problems and shortcomings in the 13 laws mentioned above and solutions to promote growth, control inflation and stabilize the macro economy; proposed to assign specific tasks to ministries and branches to implement the review and draft documents to synthesize and submit to the Government for consideration and for the Government to submit the draft law dossier to the National Assembly, especially the contents such as: authority in approving investment policies; investment project implementation process, investment termination; supplementing investment fields and State capital limits in investment projects in the form of public-private partnerships...

Concluding the meeting, Prime Minister Pham Minh Chinh, Head of the Steering Committee, acknowledged and highly appreciated the Ministry of Justice - the Standing Body of the Steering Committee and ministries, branches, localities, Committees and agencies of the National Assembly for joining hands and participating in reviewing and handling problems in the system of legal documents; as well as the quality and practical opinions of the delegates of this meeting.

The Prime Minister pointed out that the review and handling of problems in the system of legal documents must be based on practice, taking practice as a measure, in the spirit of "what is clear, mature, proven effective in practice, and agreed by the majority, then continue to be implemented; what is not yet regulated or exceeds regulations, then be amended, supplemented, and legalized"; along with that, the contents that have been included in the National Assembly's pilot resolutions must be studied and included in upcoming laws.

Emphasize the principle that law adjustment and supplementation must be urgent and truly necessary issues, aiming to create breakthroughs, remove difficulties, obstacles and bottlenecks in legal documents, serve to promote growth, control inflation and stabilize the macro economy, ensure major balances; focus on promoting decentralization, decentralization, simplifying administrative procedures, eliminating the "ask - give" mechanism, reducing inconvenience and harassment for people and businesses, clearing and effectively using all resources for development; at the same time aiming to perfect the legal system.

Based on the contents proposed by the Steering Committee for amendment and supplementation; agreeing to build 2 laws to amend many laws and amend the Law on Public Investment, meeting requirements arising from practice, the Prime Minister requested the Steering Committee, ministries, branches and localities to conduct thorough research, ensure impartiality, objectivity, transparency, and fight against group interests in law making; assess the impact, ensure certainty, feasibility and effectiveness of the law.

Assign specific tasks to each ministry and agency in synthesizing opinions and drafting legal documents; in the spirit of "having coordinated closely and effectively, we must coordinate even more closely and effectively", the Prime Minister requested the Ministry of Justice - the Standing Agency of the Steering Committee to closely coordinate with ministries, branches, localities and Committees and agencies of the National Assembly in reviewing and handling difficulties in the system of legal documents; at the same time, review sub-law documents and related legal documents and propose amendments and supplements to laws to ensure time, quality, process, procedures, high feasibility and efficiency when approved and implemented by the National Assembly.

To ensure the objectivity, comprehensiveness and accuracy of the review results, and ensure adequate basis for advising the Steering Committee, the Prime Minister requested the Standing Body of the Steering Committee to flexibly organize conferences and seminars, collect opinions from experts and scientists in the reviewed legal fields in accordance with legal regulations, create consensus on issues with different opinions among state management agencies; strengthen information and propaganda so that people, businesses, organizations and individuals can participate in contributing opinions and effectively implementing regulations when they are issued, so that the law can truly come into life.

With the motto of assigning "clear people, clear work, clear responsibilities, clear progress, clear efficiency" and requiring Ministers and Heads of agencies directly directing the work of reviewing and handling problems in the system of legal documents, the Prime Minister directed Ministries and branches to allocate investment resources for this work; strive for Ministries and branches to complete documents and send them to the Standing Agency of the Steering Committee before September 10, 2024 so that the Steering Committee can complete and submit them to the Government before September 20, 2024, in time to submit them to the 15th National Assembly at the 8th session.
