Encourage all organizations and individuals to invest
On the morning of March 10, the National Assembly Standing Committee gave its opinion on the revised Railway Law. Presenting a report at the meeting, Deputy Minister of Construction Nguyen Danh Huy said that the draft revised law has removed 20% of the number of administrative procedures and 33% of business conditions compared to the current law, meeting the requirements of simplifying and reducing administrative procedures and business conditions.

Regarding investment in developing railway infrastructure, Mr. Huy said that this amendment has added regulations to mobilize maximum local resources and other economic sectors to participate in investing in building railway infrastructure. In particular, there are regulations on encouraging all organizations and individuals to participate in investing in developing railway infrastructure through many forms of contracts (BT, BOT, BTO...).
The draft also adds regulations allowing localities to use their budgets to participate in compensation, resettlement support, and investment in the construction of some items of national railway infrastructure.
Regarding the management and exploitation of railway infrastructure, according to Mr. Huy, the draft has revised and supplemented regulations on the classification of Vietnam's railway system, including national railways, local railways and specialized railways.
“This regulation aims to address the practical needs of localities such as Binh Duong, Tay Ninh, Thanh Hoa... that have a need to invest in conventional railways (not urban railways),” said Mr. Huy.
Regarding railway transport activities, the drafting agency also amended the regulations on conditions for granting train driving licenses in the direction of not specifically regulating this content in the draft law but assigning the Minister of Construction to specify in detail.
According to Mr. Huy, this amendment also adds regulations on the list of railway industrial services and goods assigned or ordered; criteria for selecting state-owned organizations and enterprises assigned or Vietnamese organizations and enterprises "ordered"...
“Because investing in developing the railway industry requires a huge amount of capital, adding this regulation will ensure an output market for pioneering enterprises to feel secure in investing in developing the domestic railway industry,” said Mr. Huy.
There are laws, why is railway development slow?
Commenting later, Chairman of the Law and Justice Committee Hoang Thanh Tung assessed that the revised draft has not highlighted specific mechanisms and policies for railways. Agreeing with the policy of decentralization and delegation of power, he said that not all issues can be delegated to the minister.
“Issuing a ship driving license is a conditional business line and must comply with the Investment Law. Business conditions must be stipulated in the law and cannot be assigned to the minister. It is necessary to ensure consistency with relevant laws,” Mr. Tung noted.

Chairman of the Delegation Affairs Committee Nguyen Thanh Hai expressed concern when mentioning Article 8, which stipulates prohibited acts in the draft, including the prohibition of encroachment on railway traffic corridors. Not to mention spontaneously opened paths, many famous businesses and check-in places are currently also violating the law.
Ms. Hai cited that with the existing project, right in the center of Hanoi, there is a bustling tourist service business area. “This is an existing project, there must be a large amount of money to relocate households. Or even along Giai Phong Street, houses are close together next to the railway. For such an existing project, do we have any way to arrange resettlement for them?”, Ms. Hai asked.
At the meeting, National Assembly Chairman Tran Thanh Man emphasized the spirit of amending the law to have stronger decentralization and delegation of power to localities in railway management, ensuring consistency with the current legal system.

The National Assembly Chairman raised the question: Why is Vietnam's railway sector still slow to develop despite the law? Is it because we have not paid due attention, do not have investment funds, or do we only pay attention to road and air transport?
The National Assembly Chairman cited that Hanoi has the Cat Linh - Ha Dong railway, but it took 10 years to complete, while Ho Chi Minh City has just inaugurated the metro line, also very slowly. Is it because of insufficient vision, thinking, and investment that we just do it piecemeal?
The National Assembly leader suggested studying and amending the law to make it concise and effective, in order to make a breakthrough and develop the country. "The development of high-speed railways and urban railways needs to be regulated in separate chapters, with priority mechanisms for resources, technology and specialized human resource training, and learning from international experience," the National Assembly Chairman emphasized.
