9 violations of Thanh Buoi Company discovered, will transfer the case to Ho Chi Minh City Police

On October 26, the Ho Chi Minh City Department of Transport issued a press release on the inspection results of Thanh Buoi Company Limited (headquartered at 266 - 272 Le Hong Phong Street, Ward 4, District 5).

Previously, the Prime Minister issued a telegram directing the handling of the consequences of a particularly serious traffic accident in Dong Nai province.

Therefore, on October 3, the Ho Chi Minh City Department of Transport decided to establish an inspection team and so far has discovered that Thanh Buoi Company has many violations related to 9 inspection contents.

Regarding vehicles and vehicle management, Thanh Buoi Company could not extract aggregated data on vehicle records according to the form from the company's internal vehicle management software; did not fully update the vehicle's operation process into the vehicle records (number of trips per month, cumulative number of trips) on the internal management software.

When checking the journey monitoring device, many cases of drivers violating continuous driving time (over 4 hours) and violating working driving time during the day (over 10 hours) were discovered. Some cases of drivers violating by not using the driver identification card to log in information or using another driver's driver identification card to log in when driving a passenger car.

In particular, there are many cases of vehicles violating the speed limit 5 times per month.

Checking the camera's imaging equipment also found that the company did not update the driver's name and license number for some vehicles.

Regarding the management of drivers and vehicle service staff, Thanh Buoi Company did not monitor and conduct periodic health checks for drivers according to regulations, and did not fully update the drivers' work history in the driver's professional records in the company's internal human resource management software.

Regarding the freight contract, the company still lacks information about the driver and vehicle, information about contract performance, and contract value. Regarding the bill of lading, there is a lack of information about loading and unloading goods onto and off the vehicle, etc.

Checking the contents of the transportation contract and passenger list, the Department of Transport discovered that Thanh Buoi Company did not fully ensure the minimum contents specified in Article 15 of Decree No. 10/2020/ND-CP.

In particular, the list of passengers attached to the contract does not fully ensure the content according to regulations. The company organizes to pick up and drop off passengers regularly and repeatedly every day at the head office, branches, and representative offices, violating regulations.

In some cases, it was discovered that there was no transportation contract, and company employees signed contracts to transport tourists by car from Lam Dong province to Ho Chi Minh City, but were not authorized by the company's legal representative to sign the contract.

The Department of Transport's inspection team discovered that the transportation routes, times, pick-up and drop-off points of some vehicles did not match the transportation contract and the data of the journey monitoring device on some days in January and April 2023.

The inspection conclusion also pointed out that the process of ensuring traffic safety and performing the functions and tasks of the management department and monitoring traffic safety conditions of Thanh Buoi Company was not properly implemented and was incomplete.

If there are signs of law violations, the case will be transferred to Ho Chi Minh City Police.

Regarding the driver and vehicle involved in the particularly serious accident that occurred on National Highway 20, in Dinh Quan District (Dong Nai Province) on September 30, the Ho Chi Minh City Department of Transport has clarified a number of issues.

Specifically, driver Hoang Van Tinh (currently prosecuted and temporarily detained by Dinh Quan District Police) is an indefinite-term employee of Thanh Buoi Company. Driver Hoang Van Tinh has undergone a periodic health check-up, however, the driver's health check-up form has not been applied according to the Ministry of Transport's regulations and there is no driver's periodic health check-up book applied according to regulations.

Hoang Van Tinh has a Class E driver's license, issued by the Ho Chi Minh City Department of Transport on February 21, 2022, but his driver's license was revoked by the Traffic Police Department - Lam Dong Provincial Police for a period of 3 months (from August 5, 2023 to November 5, 2023). However, Tinh still drove the vehicle with license plate 50F-00483 on September 4, September 25 and September 30, the days when he caused a particularly serious accident that killed 5 people and injured 4 others.

Based on the inspection results, the HCM City Department of Transport said that it is carrying out procedures to impose administrative penalties on Thanh Buoi Company. At the same time, it will continue to verify, clarify, and impose administrative penalties on the drivers' violations.

In addition, for acts with signs of law violations discovered through inspection work, but not under the jurisdiction of the Department of Transport, they will be transferred to the Ho Chi Minh City Police and relevant agencies for consideration and handling according to regulations.

The Ho Chi Minh City Department of Transport also said that it will continue to inspect transport businesses to promptly correct and handle violations.

It is known that immediately after the above inspection results were available, on the afternoon of October 26, Ho Chi Minh City Police coordinated with related units to blockade and inspect the headquarters of Thanh Buoi Company and its branches in Ho Chi Minh City. Currently, Ho Chi Minh City Police have not yet informed about any new developments related to Thanh Buoi Company.
