On the morning of January 19, the Ministry of Education and Training held a professional consultation workshop on the development of the Law on Teachers. More than 200 legal experts, managers, universities and pedagogical colleges across the country participated in contributing their opinions.
Speaking at the opening of the workshop, Dr. Vu Minh Duc, Director of the Department of Teachers and Personnel Management (Ministry of Education and Training), said that the development of the Law on Teachers is very necessary, stemming from the decisive role of the team in education. The Prime Minister has given many instructions in the development of this law. The viewpoint of the Ministry of Education and Training is to create the most favorable conditions for the development of the teaching staff, not to add more constraints.
Since June 2023, Prime Minister Pham Minh Chinh has chaired a regular Government meeting on the proposal to develop the Law on Teachers. The Ministry of Education and Training proposed 5 policies that were unanimously approved by the Government in Resolution 95 dated July 7, 2023.
According to Mr. Pham Ngoc Thuong, Deputy Minister of Education and Training, the ministry proposed 5 policies that were unanimously approved by the Government in Resolution No. 95, including:
(1) Identifying teachers: Clearly defining teachers, clearly identifying the position and role of teachers and the characteristics of teachers' professional activities that are different from other professions, as a basis for building appropriate and suitable regimes and policies for teachers;
(2) Teachers' standards and titles: This policy stipulates teachers' professional standards, teachers' titles, and teachers' professional certificates;
(3) Recruitment, employment and working regime of teachers: Regulations on recruitment, employment and working regimes in accordance with the characteristics of activities and professional requirements for teachers; overcoming some difficulties in the current recruitment, employment and management of teachers to meet practical requirements; increasing decentralization to specialized agencies in sectors, fields and educational institutions;
(4) Training, fostering, rewarding and honoring teachers: Stipulating State policies on training and fostering those who wish to become teachers and teachers working in educational institutions, to meet professional standards and improve the quality of the team; international cooperation on teachers to raise the status of teachers; policies on salaries, policies to attract and reward teachers commensurate with their position and role, helping teachers feel secure in their work and work long-term in the education sector;
(5) State management of teachers: Stipulate principles of State management of teachers to ensure overcoming shortcomings in the recruitment, use and management of teachers in the past, in accordance with the unique characteristics of teachers' professional activities and promoting the position and role of teachers.
In addition to giving written comments, experts also directly discussed and gave comments to the Ministry of Education and Training and the Drafting Committee of the Law on Teachers on many contents such as: Identification of teachers (issues regarding the concept of teachers, professional activities, rights of teachers, etc.); professional standards and titles of teachers in higher education institutions; professional certificates of teachers; working regimes of teachers in higher education institutions; retirement regimes and extension of working time of teachers; international cooperation on teachers (conditions for teachers to go abroad to study, teach, conduct scientific research, conduct academic exchanges; standards for foreign teachers to come to Vietnam to teach)...
The Deputy Minister of Education and Training also informed about the progress of the development of the Law on Teachers. Accordingly, in order to carry out the tasks assigned by the Prime Minister, in May 2023, the Ministry of Education and Training submitted to the Government a proposal to develop the draft Law on Teachers. On July 7, 2023, the Government issued Resolution No. 95 on the Government's legal thematic meeting in June 2023, in which 5 policies were unanimously approved.
On September 5, 2023, the Government submitted a document to the National Assembly Standing Committee proposing to supplement the Law on Teachers and the Law and Ordinance Development Program for 2024. On December 12, 2023, the Secretary General of the National Assembly issued Notice No. 3206/TB-TTKQH announcing the conclusion of the National Assembly Standing Committee on the proposal to supplement the draft Law on Teachers to the Law and Ordinance Development Program for 2024. In particular, the National Assembly Standing Committee assigned the Government to direct the Ministry of Education and Training to continue completing the dossier and submit it to the National Assembly Standing Committee no later than March 1, 2024 for consideration and decision on the supplementation to the Law and Ordinance Development Program for 2024.
“If the National Assembly Standing Committee adds it to the 2024 Law and Ordinance Development Program, the progress of submitting the draft Law on Teachers to the National Assembly for consideration at the 8th session of the 15th National Assembly (expected in October 2024), submitting it to the National Assembly for approval at the 9th session of the 15th National Assembly (expected in May 2025) and the law will take effect from January 1, 2027,” Deputy Minister of Education and Training Pham Ngoc Thuong informed.
