What are the conditions for separating households to register permanent residence at the same place of residence?

The Ministry of Public Security said that Article 25 of the Law on Residence stipulates "Household separation" as follows:

1. Household members are allowed to separate to register permanent residence at the same legal residence when meeting the following conditions:

a) Have full civil act capacity; in case many members register to separate households to form a new household, among those members, at least one person must have full civil act capacity;

b) With the consent of the head of household or owner of the legal residence, except in cases where the household member registering for separation is a divorced husband or wife who is still allowed to use the same legal residence;

c) The household's permanent residence is not subject to the provisions of Article 23 of this Law.

2. The household separation dossier includes a declaration of change of residence information, clearly stating the consent to the household separation of the head of household or legal owner of accommodation, except in cases where there has been written consent.

In case of household separation after divorce as prescribed in Point b, Clause 1 of this Article, the household separation dossier includes a declaration of change of residence information, papers and documents proving the divorce and continued use of that legal residence.

3. The procedure for household separation is as follows:

a) The person registering for household separation submits the application specified in Clause 2 of this Article to the residence registration authority;

b) Within 05 working days from the date of receiving a complete and valid dossier, the residence registration agency shall be responsible for appraising and updating information about the household related to the household separation into the Residence Database and notifying the registrant of the updated information; in case of refusal to resolve the household separation, a written response must be given stating the reason.
