The Vietnam General Confederation of Labor has issued Decision 7823/QD-TLĐ on postponing union fee payments for businesses that have had their orders cut or reduced.
Accordingly, based on the proposal of the General Confederation of Labor's Finance Committee, the Presidium of the Vietnam General Confederation of Labor agreed to postpone the payment of union fees for enterprises whose orders have been cut.
Specifically, enterprises that have cut 50% or more of their employees participating in social insurance from January 1, 2023 (including employees who have stopped working, suspended labor contracts, or agreed to take unpaid leave) due to the reduction of orders will be allowed to postpone paying union fees until December 31, 2023.
The Standing Committees of the Provincial and Municipal Labor Confederations; Central and equivalent Industry Trade Unions; and General Corporation Trade Unions under the General Confederation shall review, determine and be responsible for deciding to allow enterprises whose orders have been cut or reduced to delay payment of union fees until December 31, 2023.
The Finance Board of the General Confederation of Labor; provincial and municipal Labor Federations; Central and equivalent industry trade unions, and trade unions of corporations directly under the General Confederation of Labor are responsible for implementing this Decision.
Previously, in mid-August, the Conference of the Presidium of the Vietnam General Confederation of Labor also decided to spend more than 145 billion VND to support workers who lost their jobs, had their jobs reduced, had their income reduced... affected by the crisis from the beginning of 2023 until now.
This is a support package following Decision 06 for workers who lose their jobs or are laid off from April 1, 2023 to December 31, 2023 in enterprises and cooperatives that pay union fees.
This 145 billion VND support package for union members and workers, the beneficiaries, support levels, and procedures remain the same. Specifically, workers whose daily working hours, number of working days per week or month are reduced; those who stop working for 14 days or more and have an income lower than the regional minimum wage stated in the contract will receive one million VND.
People who suspend their contracts or take unpaid leave for 30 days or more (except for personal reasons) will receive 2 million VND. Workers who lose their jobs but are not eligible for unemployment benefits are expected to receive 3 million VND in support.
The policy does not apply to those who unilaterally terminate the contract illegally, are disciplined and dismissed, fail to meet probationary requirements, or one party cancels the agreement, or those who receive monthly pensions or disability benefits.
Receiving support documents no later than January 31, 2024, completing support packages no later than March 31, 2024.
Current level and basis of union fee payment
Currently, according to Decree 191/2013/ND-CP, the contribution rate is 2% of the salary fund used as the basis for social insurance contributions for employees.
This salary fund is the total salary of employees who are subject to social insurance according to the provisions of the law on social insurance.
For units of the armed forces specified in Clause 1, Article 4 of Decree 191/2013/ND-CP, the salary fund is the total salary of national defense officers, civil servants, and employees working for wages in factories, enterprises, and basic units in the People's Army; officers, workers, civil servants, and employees working for wages in enterprises, agencies, and scientific-technical, career, and service units in the People's Public Security.
According to the Vietnam Trade Union Charter, all union members must pay a union fee of 1% of their salary as the basis for social insurance contributions. The maximum monthly contribution that union members must pay is no more than 10% of their base salary.
Non-union members are not required to pay the above union dues. Employees must pay the dues if they are union members and have a union organization. If there is no union, they do not have to pay this fee.
The subjects that must pay union fees are enterprises, organizations or employees, regardless of whether they have a union or not.
