On June 19, the Hanoi People's Court issued a decision to hold a first-instance trial of the case of leaking Biology exam questions for the 2021 high school graduation exam. In which, the defendants: Pham Thi My (60 years old) and Bui Van Sam (74 years old), former teachers, were brought to trial for the crime of "Abusing position and power while performing official duties".
Leaked exam questions for 8 family members
According to the conclusion of the investigation agency, defendants Sam and My participated in both stages: building the question bank and creating exam questions in many high school graduation exams in previous years. The two defendants knew that the software did not randomly draw questions. Therefore, in 2021, these two people took advantage of the assigned task of bringing documents home to compile into questions, then arranged them in positions to be directed to draw them as the official exam source.
A teacher in Hanoi pointed out the coincidence between the review knowledge and the 2021 high school graduation exam in Biology.
After building the exam question bank, defendant My took documents out of the designated area three times, including statistical tables of the number of newly compiled questions.
"Ms. My typed it, put it in her glasses case and brought it home, then edited, completed it, and printed two copies for me and Mr. Sam to each hold one copy," the conclusion stated.
Knowing the question extraction rules of the Ministry of Education and Training's management software, the two agreed to arrange the questions they compiled and edited into "pre-targeted" positions. The purpose was that when the computer extracted the questions to use as a source for building the exam, these questions would be combined together. Then, when participating in the Exam Council, they themselves would choose these question combinations to make the official exam.
In parallel with the process of building the question bank, the two defendants Sam and My used the above content to teach and review for 8 12th grade students who were related and acquainted and wished to apply for university admission in group B.
However, the two defendants " did not receive money from parents or students but did so out of respect and personal feelings ," the prosecution alleged. Defendant Sam stated that the only gift he received from his parents was a box of Korean ginseng.
70 - 100% of exam questions leaked
On June 8, 2021, the Ministry of Education and Training established a council to create the 2021 high school graduation exam questions, in which defendant Pham Thi My was the head of the Biology exam question group. When receiving 16 question combinations, the defendant directed and persuaded the members of the group to choose 4 question codes previously compiled by herself and Mr. Sam.
After being reviewed and edited by the members of the assessment team, these 4 exam codes changed some, but basically the exam is about 70 - 100% similar to the original.

After the end of the first round of the 2021 high school graduation exam, public opinion and the press reflected on the suspicion of leaking the Biology exam questions because they were 80% similar to the review questions on the Internet by Mr. Phan Khac Nghe (Vice Principal of Ha Tinh Specialized High School).
Regarding Mr. Phan Khac Nghe's online review questions, the Ministry of Education and Training's assessment results determined that: The questions compiled by Bui Van Sam and Pham Thi My and put into the question bank and the 4 question combinations selected as the official test building sources compared to the questions in Mr. Phan Khac Nghe's online teaching videos have 70 - 100% similar content. Among them, there are a number of questions that are identical in content, knowledge units, introductions and answers.
The investigation results determined that Mr. Phan Khac Nghe participated in the work of building the exam question bank (from 2009 to 2018) of the Ministry of Education and Training, and had an acquaintanceship with Bui Van Sam and Pham Thi My.
In 2015, 2016, and 2018, Mr. Nghe emailed Pham Thi My to contribute questions for the Biology exam.
During the process of Pham Thi My participating in building the 2021 exam question bank, Mr. Nghe also called and emailed many times to meet Pham Thi My to find out information related to the Biology exam.
However, the Security Investigation Agency, Ministry of Public Security concluded that there was no basis to determine that the accused Pham Thi My met and exchanged information and documents related to the 2021 exam question bank with Mr. Nghe.
On the other hand, because the documents Mr. Nghe taught on the Internet have no traceability value, there is not enough basis to determine that Mr. Phan Khac Nghe used documents of defendants Bui Van Sam and Pham Thi My to teach.
Ms. Pham Thi My (born in 1963) and Mr. Bui Van Sam (born in 1949) are former lecturers of the Biology Department, Hanoi National University of Education, assigned to participate in building the question bank and the Biology exam question board (high school graduation exam).
In August 2021, immediately after the news of leaked high school graduation exam questions in Biology broke out, the Department of Internal Political Security, Ministry of Public Security coordinated with the Ministry of Education and Training to conduct inspection and verification, then transferred the file to the Investigation Security Agency to conduct an investigation according to regulations.
On June 10, 2022, Ms. My and Mr. Sam were prosecuted by the Security Investigation Agency.
