The Provincial People's Committee terminated the validity of two documents on restricting land subdivision and separation on May 23.
Lam Dong Provincial People's Committee assigned the Department of Natural Resources and Environment to preside over the draft on land division and consolidation. This agency also stated that the draft will remove regulations on road opening, land acquisition for road construction, and planning and project establishment. The deadline for completing these proposals is June 25.
Previously, on July 5, 2022, Lam Dong Provincial People's Committee issued Document 4911 on handling land division and consolidation dossiers. This document makes it impossible for most individuals to divide agricultural land plots and must establish enterprises or cooperatives and establish investment projects. Only cases of land division for inheritance or donation between individuals with blood relations or relatives are processed.
Then, on March 16 this year, the province issued document 1952 to handle the problems related to this issue. The document added cases that could be processed, but there were still two conditions: only small plots of land but must be adjacent to existing roads, and at the same time, the division of plots will not form new residential areas or points, and no real estate business.
Since the end of 2021, Lam Dong province has issued 5 documents related to land division and consolidation, including the two documents above. This is also the period when the subdivision and sale of agricultural land in the locality has flourished, especially in Bao Loc city.
However, at the end of April, the Ministry of Justice sent a document requesting the Lam Dong People's Committee to inspect and handle official dispatches and decisions on conditions for land division and consolidation that the province has issued from 2021 to present.
Lam Dong provincial leaders admitted that some points in the above documents are not consistent with or overlap with the Construction Law, Housing Law and some other laws.
Regarding the regulation on land division, the Ministry of Justice previously "blew the whistle" on several localities for issuing illegal documents. According to this agency, this is the right of land users when fully applying the conditions and following the procedures prescribed by law. After the above proposal, the Hanoi People's Committee allowed land division again.
