Voters reflected that according to Decree 96/2023 detailing a number of articles of the Law on Medical Examination and Treatment, service types such as spa facilities, mother and baby care services, cosmetic services that do not use injectable anesthetics (spraying, tattooing, etc.) are not required to have an operating license. This leads to great difficulty in managing and inspecting these facilities.
Referring to the above content, Minister of Health Dao Hong Lan said that according to the provisions of the Law on Medical Examination and Treatment (effective from 2024), the types of medical examination and treatment facilities related to cosmetic services.
Including: general hospitals with cosmetic departments or performing technical services in the cosmetic specialty; specialized cosmetic hospitals; specialized cosmetic clinics.
Currently, in addition to licensed medical facilities operating in the field of aesthetics, the Minister of Health acknowledged that there are still many unlicensed aesthetic facilities operating in violation of regulations, hiding under the guise of beauty salons, skin care facilities, hair salons, and spas.
Notably, the human resources at these facilities are often not properly trained in the right scope of practice. Some cases only participate in basic vocational training courses on care, beauty, and tattooing in the form of practical instructions, but still perform techniques such as filler injection, botox,... which can cause serious consequences and complications.
In fact, large hospitals such as Central Dermatology, Viet Duc Friendship, Bach Mai or Central Eye... regularly receive cases of complications due to unsafe filler injections, botox, lasers, skin peels, and interventions beyond the capacity of the performing facility...
For example, recently, Viet Duc Friendship Hospital has received a series of cosmetic complications after filler injections. The victims are young people, and in some cases, even though they knew the injector was not a doctor, they still agreed to let them come to their home to perform this procedure. As a result, the patients suffered from occlusion of the eye's vascular system and central retinal artery, causing serious damage to the optic nerve.
Therefore, the Ministry of Health is currently reviewing the contents that need to be adjusted in Decree 96/2023 of the Government to suit the reality and ensure the management of cosmetic service establishments. The Ministry of Health will review and report to the Government to propose amendments and supplements to this Decree to strengthen the management and inspection of cosmetic service establishments.
