The 2024 Land Law was passed by the 15th National Assembly on January 18, 2024, and took effect on January 1, 2025; Article 190 regulating sea encroachment activities and Article 248 regulating amendments and supplements to a number of articles of the Forestry Law No. 16/2017/QH14 were amended and supplemented by a number of articles under Law No. 16/2023/QH15, which took effect from April 1, 2024. The 2024 Land Law has 16 chapters and 260 articles, inheriting the 2013 Land Law, drafted by the Ministry of Natural Resources and Environment, and has organized extensive public consultation nationwide.

Deputy Minister of Natural Resources and Environment Le Minh Ngan said: The 2024 Land Law has many provisions to simplify administrative procedures on land, such as eliminating intermediaries in land use management; stipulating principles for implementing administrative procedures on land to ensure equality, objectivity, publicity, transparency, simple implementation methods, easy to understand, easy to implement; supplementing the responsibilities of the Chairman of the People's Committee at each level in developing, preventing and handling violations of the law on land management and use in the area. In addition, amending and supplementing a number of articles of 8 laws related to land management and use aims to handle conflicts and overlaps between laws, creating unity and synchronization in the legal system. Thereby, aiming to unlock land resources, creating momentum for development.
Some new points of the 2024 Land Law include expanding the limit for receiving transfer of agricultural land use rights of individuals to no more than 15 times the limit for agricultural land allocation of individuals. Expanding the subjects receiving transfer of rice-growing land to individuals who do not directly produce agriculture within the land allocation limit.
Supplementing regulations that users of rice-growing land are allowed to convert the structure of crops and livestock on rice-growing land, are allowed to use part of the land area to build works directly serving agricultural production; are allowed to use it for a combination of commercial, service, livestock, medicinal plant growing purposes... but are not allowed to change the identified land type.
Encourage the concentration and accumulation of agricultural land, overcome fragmentation, create conditions to attract investment, apply mechanization and high technology to agricultural production. The Law also stipulates the announcement and disclosure of administrative procedures on land; responsibility for implementing administrative procedures on land. Administrative procedures on land are carried out directly, through the postal system or in the electronic environment and have the same legal value.
Specific regulations on procedures for allowing land use purpose change in a way that facilitates people... Recognize land use rights for people who have contracted land from farms and forestry farms before 2015. Supplement regulations on sea encroachment activities, clearly defining the conditions, principles, and responsibilities of the State, organizations, and individuals related to sea encroachment activities.
To resolve conflicts and overlaps between laws, creating consistency and synchronization in the legal system, the 2024 Land Law has amended and supplemented a number of articles of 8 laws with regulations related to land management and use, including the laws on: Planning, Investment, Forestry, Fisheries, Organization of local government, Civil enforcement, Personal income tax, Non-agricultural land use tax. The provisions on the authority to allocate and lease land of economic zone management boards, high-tech zone management boards, and airport authorities are eliminated.
Minister of Natural Resources and Environment Dang Quoc Khanh said that to implement the provisions of the 2024 Land Law, the Ministry of Natural Resources and Environment is drafting 6 decrees and 8 circulars to guide its implementation. In addition, other ministries and sectors are drafting decrees to guide related contents. On the basis of the 2024 Land Law, ministries, sectors and localities need to closely follow the regulations, especially new regulations, and prepare conditions for implementation when the law comes into effect. Promote propaganda and organize the dissemination of the 2024 Land Law widely among the people, and soon put the law into practice to fully exploit the potential and advantages of land resources, contributing to promoting socio-economic development.
