Students voluntarily write applications for extra classes, are teachers allowed to teach?

Extra teaching and learning are activities outside the time limit specified in the education plan for the subject. Article 4, Circular 29/2024 issued by the Ministry of Education and Training clearly stipulates cases where teachers are not allowed to give extra teaching, including:

• Tutoring primary school students except for arts, sports and life skills.
• Teachers are not allowed to teach extra classes outside for money to their own students who are being taught at school.
• Public teachers are not allowed to participate in the management and operation of extra-curricular teaching but can still participate in extra-curricular teaching.

Based on the above content, if the participants are regular students or primary school students, teachers are not allowed to teach students at home for money, even if the students voluntarily apply for extra classes.

Private tutors must register their business.

Regarding extra-curricular teaching and learning activities, Article 6 of Circular 29/2024 stipulates each specific case and requires full implementation.

Accordingly, organizations or individuals organizing extra-curricular teaching and learning activities outside of school with fees from students must register their business according to the provisions of law. At the same time, it is necessary to publicize the subjects organized for extra teaching; the duration of extra teaching for each subject according to each grade level; the location, form, and time of organizing extra teaching and learning; the list of extra teachers and the amount of extra tuition fees before enrolling students for extra teaching and learning classes.

Extracurricular tutors must ensure good moral qualities and professional competence appropriate to the subjects they teach.

When participating in extra-curricular teaching, teachers must report to the Principal or Director or head of the school about the subject, location, form, and time of extra-curricular teaching.
