Seven defendants were on trial, including four former soldiers: Ho Anh Son, former lieutenant colonel, former deputy director of the Military Medical Research Institute; Nguyen Van Hieu, former colonel, former head of the Equipment and Supplies Department; Ngo Anh Tuan, former major, former head of the Finance Department; Le Truong Minh, former major, former head of the Pharmaceutical Chemistry Department. The units where these former soldiers worked were all under the Military Medical Academy.
In addition, there are defendants Trinh Thanh Hung, former Deputy Director of the Department of Science and Technology of Economic and Technical Sectors, Ministry of Science and Technology; Phan Quoc Viet, General Director of Viet A Company; Vu Dinh Hiep, Deputy General Director of Viet A Company.

Defendant Phan Quoc Viet was prosecuted for two crimes: abusing his position and power while performing official duties and violating bidding regulations causing serious consequences.
The two defendants Trinh Thanh Hung and Ho Anh Son were both prosecuted for abusing their positions and powers while performing official duties. The remaining four defendants were also prosecuted for violating bidding regulations causing serious consequences.

According to the indictment of the Central Military Procuracy, in January 2020, when the Covid-19 epidemic broke out, the Military Medical Academy proposed to the Ministry of Science and Technology to carry out the task of researching a diagnostic kit for pneumonia caused by the Corona virus. The project was approved by the Ministry of Science and Technology with a budget of nearly 19 billion VND from the budget, assigned to the Military Medical Academy to preside over, with former Lieutenant Colonel Ho Anh Son as the project manager.
During the approval process, due to personal gain and his acquaintance with Mr. Phan Quoc Viet, defendant Trinh Thanh Hung asked defendant Son to bring Viet A Company to participate in the project. In which, the Military Medical Academy was responsible for developing the process, and Viet A Company manufactured 20,000 test kits for testing.

However, instead of using the research results from the topic, the three defendants Hung, Viet and Son agreed to use the kit provided by Viet A Company to accept phase 1.
With this deception, the research topic was approved, the Ministry of Health successively granted temporary license and then circulation license for the test kit.

Viet A Company produced more than 8.7 million test kits, inflated prices, and sold them to medical facilities across the country, illegally profiting more than VND 1,235 billion. Defendant Phan Quoc Viet compensated Trinh Thanh Hung 350,000 USD and Ho Anh Son nearly VND 2.5 billion.

The prosecution agency also determined that the acceptance of the test kit research project chaired by the Military Medical Academy was not carried out in accordance with its nature, because the product to prove the research results was the kit provided by Viet A Company, not the product manufactured according to the research process of this unit.
That is, the research process of the Military Medical Academy had no products (for testing and evaluation), did not complete the research task, causing a loss of nearly 18.5 billion VND out of a total of nearly 19 billion VND disbursed.
