People of Kim Xuyen commune (Kim Thanh) receive support and compensation for site clearance for the National Highway 5 interchange project.
Ensuring the rights of people whose land is recovered
To implement the Project of Building the Interchange connecting National Highway 17B with National Highway 5, Hanoi - Hai Phong Railway through Kim Xuyen Commune, Kim Thanh District, more than 15 hectares of residential land and agricultural land of 291 organizations and individuals must be recovered.
For garden land and ponds in the same plot of land with houses but not recognized as residential land; houses and constructions serving the daily life of families and individuals that were illegally built but did not have administrative penalty documents or prevention records from competent authorities before the date of land reclamation notice... the district has decided to provide other support according to Article 108 of the Land Law. 118 households have received a total support amount of over 34 billion VND for these types of land.
Recently, the district also decided to provide other support to 17 households whose land was recovered to implement the Kim Lien – Kim Tan Bridge and Access Road Construction Project. The total support amount is more than 378 million VND.
Ms. Le Thi Thuy Van, Head of the Department of Agriculture and Environment of Kim Thanh district, said that according to the compensation policy stipulated in the 2024 Land Law, households with trees, crops, and constructions on illegal land subject to land acquisition for project implementation will not be compensated. However, Clause 2, Article 108 of this law states that "based on the actual situation in the locality, the Provincial People's Committee shall decide on other measures and levels of support to ensure housing, stabilize life, and production for people whose land is acquired, and property owners for each specific project".
Based on this and the guiding decrees, the Provincial People's Committee has decided to decentralize to the District People's Committees, based on the actual situation in the locality, to decide on different measures and support levels for each project. The Kim Thanh District Compensation and Resettlement Support Council has advised the District People's Committee to decide on different support levels for each specific case and project.
“The decision on different support levels according to Clause 2, Article 108 of the 2024 Land Law is a very humane policy to ensure the rights and interests of people whose land is recovered. Therefore, during the implementation process, Kim Thanh district always puts the interests of people whose land is recovered first,” said Ms. Van.
The project to upgrade provincial road 390B and build a bypass section of Thanh Ha town center is a major traffic project of special importance to Thanh Ha district. To implement this project, Thanh Ha district must reclaim more than 260,000 m2 of land . Among them, many households have trees and crops grown on illegally used land.
Based on local realities, Thanh Ha district has decided to provide other support to ensure housing and stabilize people's lives. Accordingly, depending on the type, the level of other support is equal to 20% - 25% of the compensation level upon recovery.
Mr. Nguyen Van Vien's family is one of 20 households in Cam Viet commune that Thanh Ha district applied a different level of support when their land was recovered. They said that their family had assets, trees and crops illegally established on agricultural land, and according to general regulations, they would not be compensated.
However, after requesting and knowing that his name was on the list of other compensation and support options of Thanh Ha district, his family was very happy. He and his family were ready to move their assets and hand over the site to the investor.
Create high consensus in land clearance
The project to renovate and upgrade provincial road 390 from Hop Thanh bridge to Quang Thanh bridge is one of two projects that Thanh Ha district has decided to support according to Clause 2, Article 108 of the 2024 Land Law.
By early January 2025, Kim Thanh district had completed site clearance for the Project to build an intersection connecting National Highway 17B with National Highway 5 and the Hanoi - Hai Phong railway through Kim Xuyen commune, 1 month ahead of schedule. Currently, the project has been implemented by the construction unit to ensure the project is on schedule.
This result, in addition to the participation of the entire political system from the district to the grassroots level, the early issuance of other support decisions for households whose land was recovered for the project, has significantly contributed to creating consensus in handover and site clearance.
After the Land Law 2024 took effect, the Provincial People's Committee issued Decision No. 28/2024/QD-UBND dated August 9, 2024 detailing a number of articles and implementation measures on compensation, support, and resettlement when the State acquires land in the province; Decision No. 51/2024/QD-UBND dated November 22, 2024 of the Provincial People's Committee supplemented the regulations issued with Decision No. 28/2024/QD-UBND.
Based on the provincial document, Binh Giang district has urgently reviewed each project, determined the origin of the land, and compiled opinions and recommendations from people whose land was recovered to issue other support decisions. Currently, the district is finalizing other support plans according to Clause 2, Article 108 of the Land Law for 3 projects: the residential area south of Ke Sat town, the new residential area along the old National Highway 38 section through Ke Sat town, and the residential area along the Sat River.
According to Mr. Nhu Van Chuyen, Vice Chairman of Binh Giang District People's Committee, site clearance is a difficult task in implementing projects. The issuance of other support policies according to Clause 2, Article 108 of the Land Law and Decision 28, Decision 51 of the Provincial People's Committee not only contributes to ensuring stable lives of people whose land is recovered but also creates consensus, speeds up the site clearance progress of projects, and promotes disbursement of public investment capital.
