Conditions for enjoying policies and regimes
a) Officers, professional soldiers, defense officials, and people working in the Government Cipher Committee who receive salaries as military personnel specified in Clause 1 and Clause 4 , Article 2 of this Circular, hold positions and titles in the structure of participating in the Party Committee, full-time members of the Inspection Committee at the same level but do not meet the age requirements for re-election or reappointment of the Party Committee for a new term.
b) The subjects in Point a of this Clause who meet the age requirements for re-election or reappointment to the new term Party Committee have a working period from the date of the congress starting from 30 months to 60 months; in special cases, the remaining period is from 12 months to less than 30 months, the highest service age has expired or the retirement age has reached according to the instructions in Clause 5, Article 5 of this Circular , but due to the arrangement of Party Committee personnel, they wish to retire and have been approved by the competent authority.
c) Subjects specified in Clauses 1, 2, 4 and 5, Article 2 of this Circular who are participating in Party committees (5-year term) must end their activities and complete the organizational apparatus with 5 years (60 months) or less remaining before the highest service age expires or reaches retirement age according to the instructions in Point a, Point b, Clause 5, Article 5 of this Circular, and wish to retire early to create conditions for arranging Party committee personnel in Party congresses at all levels leading up to the 14th National Congress of the Party and are approved by competent authorities.
How to calculate benefits
The subjects specified in Clause 1 of this Article who are eligible for early retirement are entitled to the benefits specified in Clause 8, Article 1 of Decree No. 67/2025/ND-CP. In which:
a) The allowance regime for the number of years of early retirement and the allowance regime according to the working time with compulsory social insurance payment shall be implemented according to the instructions at Point b, Point c, Clause 1 and Clause 3, Article 6 of this Circular .
- The allowance for the number of years of early retirement is calculated as follows:
Benefit level for years of early retirement | = | Current monthly salary as guided in Clause 3, Article 4 of this Circular | x 5 x | Number of years of early retirement as guided in Clause 2, Article 5 of this Circular |
- Allowance based on working time with compulsory social insurance is calculated as follows:
- Receive a subsidy of 5 months of current salary for the first 20 years of work with mandatory social insurance. From the 21st year onwards, for each year of work with mandatory social insurance, a subsidy of 0.5 months of current salary will be provided.
Allowance level based on working time with compulsory social insurance | = | Current monthly salary as guided in Clause 3, Article 4 of this Circular | x | 5 (for the first 20 years of work with mandatory social insurance) | + | 0.5 x | Number of years of work with compulsory social insurance from the 21st year onwards |
- In case of 15 years of work or more, paying compulsory social insurance and being eligible for pension according to the provisions of the law on social insurance at the time of early retirement, the employee will receive a subsidy of 4 months of current salary for the first 15 years of work; from the 16th year onwards, for each year of work with compulsory social insurance payment, the subsidy is equal to 0.5 months of current salary.

Lump-sum retirement benefits for months of early retirement are as follows:
- Retire within the first 12 months from the effective date of the decision on organizational arrangement of the competent authority:
One-time pension benefit level | = | Current monthly salary as guided in Clause 3, Article 4 of this Circular | x 1.0 x | Number of months of early retirement as instructed in Clause 1, Article 5 of this Circular |
- Retirement from the 13th month onwards from the effective date of the decision on organizational arrangement of the competent authority:
One-time pension benefit level | = | Current monthly salary as guided in Clause 3, Article 4 of this Circular | x 0.5 x | Number of months of early retirement as instructed in Clause 1, Article 5 of this Circular |
b) One-time retirement benefits for the number of months of early retirement are implemented as follows:
One-time pension benefit level | = | Current monthly salary as guided in Clause 3, Article 4 of this Circular | x 1.0 x | Number of months of early retirement as instructed in Clause 1, Article 5 of this Circular |
The Ministry of National Defense is organizing to collect opinions on the second draft of the Circular on policies and regimes when arranging and streamlining the organizational apparatus in the Army to continue to edit and perfect the document.
This draft Circular has 18 articles, an increase of 6 articles compared to the previous draft circular; expands the scope of application to guide the implementation of policies and regimes for subjects under the management of the Ministry of National Defense in implementing organizational restructuring; streamlining payroll, restructuring, improving the quality of staff; cadres who are not old enough to be re-elected, re-appointed or are eligible for re-election, re-appointed; cadres participating in Party committees at Party committees must end their activities according to the provisions of Articles 7, 8, 9, 10, 11 and 14 of Decree No. 178/2024/ND-CP, Clauses 5, 6, 7, 8, 9, 10 and 11 of Article 1 of Decree No. 67/2025/ND-CP; responsibilities of relevant agencies, units and individuals.
