The Supreme People's Procuracy has just issued an indictment to prosecute Ms. Truong My Lan (Chairwoman of Van Thinh Phat Group) and 85 defendants in the case that occurred at Van Thinh Phat Group, SCB Bank and related units and organizations.
The defendants were prosecuted for the crimes of embezzlement of property; violation of regulations on banking activities and other activities related to banking activities; bribery; receiving bribes; taking advantage of positions and powers while performing official duties; lack of responsibility causing serious consequences; abuse of trust to appropriate property.
Defendant Nguyen Cao Tri (Chairman of the Board of Directors of Van Lang Company, Chairman of the Board of Directors and General Director of Capella Group) was prosecuted for the crime of abuse of trust to appropriate property.
Mr. Tri was accused by the prosecution agency of appropriating 1,000 billion VND from Ms. Truong My Lan.

Forged documents to appropriate money from the Chairman of Van Thinh Phat
According to the indictment, Mr. Nguyen Cao Tri is Chairman and General Director of Van Lang Education Investment and Management Joint Stock Company (Van Lang Company), Capella Group Joint Stock Company.
From 2017 to 2020, Ms. Truong My Lan repeatedly transferred money through employees to buy shares in several projects of Nguyen Cao Tri at: Industrial Rubber Joint Stock Company (in Dong Nai); Saigon Dai Ninh Tourism Investment Joint Stock Company (in Lam Dong) and cooperated in investing in projects in Hai Ha district, Quang Ninh province.
In December 2017, Mr. Tri transferred 65% of the charter capital of Industrial Rubber Joint Stock Company to Truong My Lan for 45 million USD. Ms. Lan transferred 21.25 million USD (equivalent to 31.22% of the charter capital) to Tri three times.
Regarding Saigon Dai Ninh Tourism Investment Joint Stock Company, the prosecution agency determined that Nguyen Cao Tri, who held 58% of the charter capital, sold all shares to Truong My Lan for VND3,000 billion. During the transfer process, the Chairman of Van Thinh Phat deposited 1 million USD and VND127 billion.
In addition, Mr. Tri and Ms. Lan also agreed to let the Chairman of Van Thinh Phat participate in investing in the project in Hai Ha district, paying according to the progress of arising costs. Accordingly, Ms. Lan paid Mr. Tri a total of 9.5 million USD twice, equivalent to more than 220 billion VND.
According to the indictment, due to receiving many investment and loan amounts without documents or receipts, in January 2021, Mr. Tri met Ms. Lan at Ngan Dinh restaurant (TimeSquare building of Van Thinh Phat Group) to agree to close the investments, Ms. Lan transferred a total of 1,000 billion VND to Tri.
To ensure credibility and trust for the above amount, Mr. Tri agreed to transfer to Ms. Lan 10% of the charter capital of Van Lang Company and agreed with Ms. Lan to let Ho Quoc Minh own the shares.
On October 21, 2022, Mr. Tri directed his assistant to draft documents to adjust prices and liquidate all contracts to transfer 10% of Van Lang Company's charter capital signed with Ms. Lan.
Documents created for falsification, validating the transaction date such as: Minutes of agreement to adjust contract transfer price; Share transfer contract, adjusting transfer price of more than 4.4 million VLG shares...
After that, Mr. Tri completed the documents and completed the procedures to confirm the transfer of more than 4.4 million shares (equivalent to 10% of charter capital) from Ho Quoc Minh to his younger brother Nguyen Cao Duc and Tran Le Diep Thuy (accountant of Van Lang Company).
On October 23, 2022, Mr. Tri made an appointment to meet Mr. Minh at a coffee shop at Tan Son Nhat Airport and asked him to sign some documents to liquidate the transfer contract, the minutes of liquidation of the investment trust contract...
Consciousness of appropriating 1,000 billion VND
During the investigation process from December 26, 2022 to November 15, Nguyen Cao Tri did not admit to receiving money from Truong My Lan.
Nguyen Cao Tri stated that meeting Ho Quoc Minh at Tan Son Nhat airport was by chance, and that he did not hand over any papers or documents for Ho Quoc Minh to sign.

Afterwards, although there was a conclusion of the forensic examination No. 20 dated January 6, 2023 of the Institute of Criminal Science, Ministry of Public Security, identifying Nguyen Cao Tri's handwriting in the documents created by Tri for monitoring, confirming the amount of money received from Truong My Lan seized by the investigation agency, Nguyen Cao Tri still did not admit to receiving money from Truong My Lan. The defendant claimed that Truong My Lan slandered and defamed Tri's honor.
According to the Supreme People's Procuracy, this shows Truong My Lan's intention to appropriate money to the end.
Defendant Truong My Lan has filed a petition requesting clarification and handling of Nguyen Cao Tri's act of appropriating her property and recovering the amount of 1,000 billion VND to resolve according to the law.
Based on documents, evidence, expert conclusions, statements of the accused and related individuals, the prosecution agency has sufficient grounds to determine that: Taking advantage of Truong My Lan's arrest, Nguyen Cao Tri fraudulently directed employees to prepare and complete documents to liquidate the transfer contract and liquidate the investment trust contract to eliminate debt obligations, in order to appropriate the amount of 1,000 billion VND received from Truong My Lan.
During the investigation, the authorities seized cash when searching Nguyen Cao Tri's person and workplace, totaling 93.9 billion, including 3.3 million USD and 16.7 billion VND. The family of the defendant Nguyen Cao Tri paid 640.7 billion VND into the temporary account of the investigation agency.
Regarding mitigating circumstances, according to the Supreme People's Procuracy, Mr. Tri was awarded the Third Class Labor Medal and a certificate of merit, actively participated in charity activities, epidemic prevention, contributed to the community and had a good personal history.
