According to Ho Chi Minh City Police, loan sharking and illegal debt collection are crimes that cause social pain. The City Police have implemented many measures to fight against this type of crime.
In a recent report on the security and order situation in November 2023, Ho Chi Minh City Police said that they have focused on dismantling criminal gangs hiding under the guise of pawnshops, financial companies, and law firms to operate illegal credit and conduct debt collection activities that violate the law.
In the past 11 months, Ho Chi Minh City Police have discovered 219 cases with 346 subjects related to illegal credit. Through investigation, the professional departments of Ho Chi Minh City Police, the Police of 21 districts and Thu Duc City have prosecuted 81 cases with 217 defendants for the crimes of "Lending at high interest rates in civil transactions", "Extortion of property"...
In addition, the police agency also handled 29 administrative violations, with 29 subjects showing signs of illegal credit activities, debt collection methods such as threats, terrorism, and spreading false information about others.
According to the Office of the Criminal Police Department (C01) of the Ministry of Public Security, preventing and repelling "black credit" is an urgent requirement today to improve the credit market, stabilize people's lives, and ensure security and order.
Based on the investigation and discovery of black credit cases, C01 has just made recommendations and proposed to the Government and State management agencies a number of options, such as:
Resolutely and seriously implement the provisions of the law, directives of the Party, the State and relevant ministries and branches on the prevention, suppression and handling of "black credit" activities, especially Directive No. 12/CT-TTg dated April 25, 2019 of the Prime Minister on "Strengthening the prevention and fight against crimes and violations of the law related to black credit"....
Recommend the State Bank to study, advise, and perfect legal regulations on banking credit mechanisms and policies, develop the credit system, diversify loan types, banking products and services with quick and convenient procedures, and meet the legitimate and legal borrowing needs of individuals and organizations.
Law enforcement agencies strengthen prevention and combat against crimes related to "black credit" to promptly educate, deter, and prevent in general.
Recommend the Ministry of Information and Communications and relevant press agencies to strengthen propaganda, dissemination and legal education to raise people's awareness and consciousness about credit and lending activities outside of credit institutions, to see the risks and consequences of borrowing "black credit".
