However, Ms. Thuy also said that currently, there is a problem with DTHT, which is that many teachers do not teach well in class so they can teach extra classes outside, forcing students to take extra classes to get high scores on tests in class. This causes frustration among parents and reduces the quality of teaching in schools, losing the legitimate meaning of DTHT.

Faced with that situation, Ms. Thuy said: "Making tutoring a conditional business is completely reasonable. It is a business because tutoring centers need to be run by enterprises under state management and subject to all current laws and documents related to the business and education sectors, but there must be conditions because this is a special field that not everyone can participate in. Participants in this field must have knowledge of education and must ensure conditions regarding qualifications, ethical criteria and educational philosophy. There must be conditions to limit those who take advantage of their position in schools to bring students out for tutoring."

Teacher Dinh Duc Hien (FPT Education System) also believes that private tutoring is a need and it operates like the "law of supply and demand of society". However, private tutoring has lacked uniformity, is loose in management, and has been transformed in many ways, causing frustration in society. If private tutoring is a value-added service, we will have to have regulations related to it and a legal corridor, related laws and it must become a conditional business.

The principal of a primary school in Thanh Xuan District (Hanoi) also said that he is looking forward to having a legal corridor and strong enough sanctions to manage extracurricular activities, because Circular 17 currently stipulates that principals must be responsible for their teachers teaching extracurricular activities. "The regulation sounds strict but in fact it is not feasible. We can only remind our teachers not to violate the regulations on extracurricular activities, but we cannot control the activities taking place outside of school, so asking the principal to be responsible is very unreasonable," he said.

Associate Professor Tran Xuan Nhi, former Deputy Minister of Education and Training, supports considering tutoring as a conditional business and explains: "For example, tuition fees must be regulated within the ceiling and floor thresholds, what content teachers are allowed to teach, what teaching conditions are... all must have specific regulations. Classes must meet all of those conditions."

NEED ROOT SOLUTIONS TO MANAGE EXTRA LEARNING

According to Ms. Ng.H (residing in District 8, Ho Chi Minh City), who has two children studying in junior high school, the need for children to take extra classes is very real, both on the part of students and parents. "However, there needs to be a legal corridor to strictly manage DTHT, so that teachers do not rush to teach extra classes outside and neglect their regular teaching, ensuring that there is no situation where extra classes are taught in advance and students are not allowed to take extra classes...", this parent spoke up.

Associate Professor, Dr. Nguyen Dinh Quan, Ho Chi Minh City University of Technology (Ho Chi Minh City National University), said that it is not true that students today only study extra subjects such as math, literature, physics, chemistry, etc. They study a lot of other knowledge, it could be soft skills, it could be knowledge about information technology, it could be foreign languages, etc. and clearly this is a legitimate need, so the tutoring market is real, because if there is demand, there will be supply. "If the supply and demand market for tutoring is linked to the need for students to actually study, not because of the negative competition for achievements and scores, then this is not a problem. To change the root of the problem of DTHT, to limit negativity, we need a macro strategy to reform the entire education system," Associate Professor, Dr. Nguyen Dinh Quan said.

Talking to Thanh Nien Newspaper reporter, an education expert in Ho Chi Minh City said that it is necessary to clarify the concept of DTHT. Teaching and learning additional subjects such as math, physics, chemistry, biology, English... is clear, but teaching and learning subjects such as robotics, math thinking, music, fine arts, cultural sports... can be called DTHT or not? And when the Ministry of Education and Training proposed that teaching additional subjects is a conditional business, does opening a center to teach other subjects (robotics, math thinking, music...) also need to be a conditional business?

According to the above education expert, extra classes are now a need. So, what is needed here is a clear regulation, a legal corridor to effectively manage, monitor and prevent negative incidents such as "forcing" students to take extra classes.

"In reality, there are people who earn hundreds of millions of dong per month by tutoring but do not pay any tax. Normally, other workers are subject to very strict tax regulations. So there needs to be regulations to strictly manage and create fairness for education," said this expert.

TEACHING IS COMPLETELY DIFFERENT FROM OTHER BUSINESSES

Meanwhile, teacher Nguyen Xuan Khang, Principal of Marie Curie School (Hanoi), said that in education, especially general education, for many years now, there has been a widespread phenomenon of extra teaching, causing public outrage. However, Mr. Khang disagrees with including extra teaching as one of the conditional business sectors, because: "Although widespread extra teaching is a painful issue, it does not affect national defense and security; does not affect social order and safety... like the current conditional business sectors. Therefore, it is not necessary to add a conditional business sector (the 228th sector) to the Investment Law".

National Assembly delegate Nguyen Thi Viet Nga (Hai Duong) also said that making tutoring a conditional business is an issue that needs to be thoroughly recognized and studied, not just for ease of management. Because teaching is completely different from other business sectors, if it is now included in the list of conditional business sectors for licensing, how will the licensing assessment be, especially the assessment of teachers, it will be very difficult...

Management of extracurricular tutoring is facing difficulties.

Decision No. 2499 issued on August 26, 2019 by the Minister of Education and Training announced the expiration of Articles 6, 8, 9, 10, 11, 12, 13 and 14 of Circular 17 issued on May 16, 2012 regulating DTHT. Accordingly, a series of important regulations in DTHT management have expired, including: on organizing DTHT outside schools; requirements for tutors; requirements for DTHT organizers; facilities serving DTHT; authority to grant licenses to organize DTHT activities; licensing dossiers; procedures for granting licenses to organize DTHT activities; duration, extension, revocation of licenses to organize DTHT activities; suspension of DTHT activities. The reason why the Ministry of Education and Training announced the expiration of the regulations on DTHT is because the legal basis of this regulation in Clause 3, Article 74 of the Investment Law has expired since July 1, 2016. Specifically, in 2016, the National Assembly passed a law amending and supplementing the Investment Law, which added a list of conditional industries, so DTHT is not a conditional business type. Or according to the Law on Promulgation of Legal Norms, the Ministry of Education and Training is not allowed to issue regulations on administrative procedures. Therefore, the adjustment of Circular 17 is to comply with current laws. Because there are no other regulations to replace it, the licensing and management of DTHT outside of schools in all localities in recent years has been very confusing and difficult.
