The Land Law Project (amended) was discussed by the National Assembly at the 4th, 5th and 6th sessions. At the end of November 2023, with 453/459 delegates present in agreement, the National Assembly agreed to postpone the approval of the revised Land Law project from the 6th session to the nearest session.
Secretary General of the National Assembly Bui Van Cuong said that the revised Land Law project is of special importance, having a great impact on socio-economic activities, people's lives, as well as the country's development.
The National Assembly decided to adjust the time for submitting the revised Land Law for consideration and approval to the nearest session so that agencies have more time to research, absorb, revise, thoroughly review and perfect the draft law, ensuring the best quality before submitting it to the National Assembly for approval.
At the 6th session, the National Assembly agreed to postpone the approval of the Land Law project (amended).
Speaking with Nguoi Dua Tin , National Assembly Deputy Pham Van Hoa - Member of the National Assembly's Law Committee, delegate from Dong Thap said that the National Assembly has given its opinions on the revised Land Law for the third time and there are still many different opinions. Because this is a very important Law project closely related to people's lives.
Meanwhile, the 2013 Land Law has revealed many shortcomings and limitations, so it is necessary to comprehensively amend the Law, with national significance, especially to bring more benefits to the people.
“Therefore, I think that the revision of the Law has been strongly participated in, so it is necessary to be more determined by the relevant sectors, to absorb and explain the opinions of the people and the National Assembly deputies in accordance with the practical situation,” Mr. Hoa said, adding that when the Land Law (amended) is passed, it will have a very important meaning, which is that it will comprehensively change the State's land management and the people's land ownership.
According to Mr. Hoa, through recording the opinions of voters and people, voters and people all hope that the Land Law will be passed at the upcoming extraordinary session, and when it comes into effect, it will be well implemented.
In addition, Mr. Hoa also said that with the amendment of the Land Law, it is still necessary to pay attention to a number of issues. Specifically, according to Mr. Hoa, the core issue is still the issue of land recovery for socio-economic and national defense and security purposes, as well as land recovery for commercial purposes with land rent differences.
“These are issues that people have been very concerned about recently, how to recover land, compensate for land, and resettle people in a fair manner, with the value of recovered land being equivalent or equal to the actual market value,” Mr. Hoa said this is a point that needs attention.
In addition, if land is recovered with a difference in land rent, it is necessary to calculate the interests of the people and businesses in harmony. In particular, the interests of the people must be put first.
One point that the Dong Thap delegation was also very concerned about was the issue of resettlement. He said that before land acquisition, there must be a resettlement area.
“The resettlement area must be complete, the new accommodation must be equivalent or equal to the old accommodation”, this is an issue that needs to be clearly regulated.
National Assembly Deputy Pham Van Hoa hopes that the National Assembly will reach consensus and unanimity to pass the Land Law (amended) at the extraordinary session.
Or the issue of transferring agricultural land use rights to those who do not directly cultivate; inheritance; land division; compensation, site clearance... also receive attention.
Therefore, delegates highly expect the National Assembly to reach consensus and unanimity to pass the Land Law (amended) at the upcoming extraordinary session. When the Law comes into effect, it must be applied according to the new law, bringing practical benefits to the people.
Previously, on December 18, at the 28th Session of the National Assembly Standing Committee, Secretary General of the National Assembly and Head of the National Assembly Office Bui Van Cuong reported on preparations for the 5th Extraordinary Session of the National Assembly.
Secretary General of the National Assembly, Head of the National Assembly Office Bui Van Cuong said that, based on the review of the quality of preparation, if the documents are qualified, ensuring progress and quality, it is proposed to submit to the National Assembly at the 5th Extraordinary Session the following contents: Consider passing the draft Law on Land (amended) and the draft Law on Credit Institutions (amended) if qualified;
Consider and approve the Draft Resolution on a number of specific mechanisms and policies to remove difficulties and obstacles, and speed up the implementation of National Target Programs;
Consider and approve the Resolution on supplementing the Central Budget Medium-Term Public Investment Plan for the 2021-2025 period from the general reserve source corresponding to the source of increased revenue and savings from the Central Budget in 2022 for public investment tasks and projects and supplementing the Vietnam Electricity Medium-Term Public Investment Plan from the reserve source of the Medium-Term Public Investment Plan (if any).
Regarding the meeting format, the National Assembly will convene at the National Assembly House. The National Assembly is expected to meet for 3 days, opening on January 15, 2024, and divided into 2 sessions. Session 1 is 2.5 days (from January 15 to the morning of January 17); session 2 takes place in half a day (afternoon of January 19) to pass laws, resolutions and close the session.
At a recent working session with the Economic Committee and the Ministry of Natural Resources and Environment on the draft Land Law (amended), the Economic Committee's report said that by the end of December 18, 2023, 232/265 articles of the draft law had been thoroughly reviewed. After the review, the agencies agreed to continue to amend and supplement 35 groups of articles and clauses.
Chairman of the Economic Committee Vu Hong Thanh raised 3 contents to continue reporting to the National Assembly Standing Committee, requesting the Government to clarify the basis, have official opinions and design specific plans including:
Firstly, regarding the subjects allowed to use national defense and security land in combination with labor production and economic construction activities;
Second, on the rights and obligations of military and police enterprises when using national defense and security land in combination with production labor and economic construction activities;
Third, on the content of land valuation methods and the cases and conditions for applying each method.
National Assembly Chairman Vuong Dinh Hue said that out of 27 major issues with different opinions, 22 have so far been agreed upon. There are only 3 major issues and a number of other issues to be discussed. The National Assembly Chairman said that there is a basis for submitting the revised Land Law to the National Assembly for approval at the extraordinary session next January .
