Can the criminal police stop cars for inspection?

Pursuant to Article 87 of Consolidated Document No. 15/VBHN-VPQH, the authority of the road traffic police is stipulated as follows:

– Road traffic police conduct patrols and controls to control people and vehicles participating in road traffic.

– For road traffic participants who violate traffic regulations, the traffic police will handle the violation.

– Coordinate with road management agencies to detect and prevent violations of regulations on protection of road works and road safety corridors.

Thus, traffic police are authorized to stop vehicles of traffic participants.

Pursuant to Clause 3, Article 87 of Consolidated Document No. 15/VBHN-VPQH, it is also stipulated that in addition to the traffic police, other police forces as well as commune police have the right to coordinate with the road traffic police to participate in patrolling and controlling road traffic order and safety when necessary. Specifically including:

– Transport inspector:

With the task of inspecting the compliance with laws, procedures, regulations, standards, and technical regulations on traffic of organizations and individuals, inspectors and inspection officers are allowed to stop road vehicles in the following cases:

+ Force to stop administrative violations.

+ Detecting vehicles participating in traffic with one of the following signs of violations:

Exceeding the permitted size limit. Exceeding the permitted load. Tracked vehicles traveling directly on the road without taking protective measures. Dumping soil, construction materials, and other waste illegally onto the road or into the road safety corridor. In addition, the traffic inspection force also has the right to draw up a record to fine violators.

– In addition, the following forces are mobilized to patrol and control traffic with the Traffic Police including: Order Police, Rapid Response Police, Mobile Police, Security Police, Administrative Police for Social Order and Safety, Commune Police, Ward Police and Commune Police.

Accordingly, the above forces participate when:

+ There are peak periods of patrolling and controlling traffic.

+ Time of celebration; political - social events; major cultural and sports activities.

+ In cases where traffic order and safety adversely affect political security, order and social safety.

+ When the situation of violations of order, traffic safety, accidents and traffic jams becomes complicated.

– Other forces such as market management, environmental protection inspectors, maritime port authorities, airport authorities, inland waterway port authorities, fire prevention and fighting and rescue police, etc.

When performing assigned functions and tasks, these forces also have the authority to impose penalties for traffic violations related to the fields they are responsible for.

In addition, in large cities such as Hanoi and Ho Chi Minh City, there are also forces 141 and 363. These forces are interdisciplinary working groups including: Traffic police, mobile police; criminal police with the task of patrolling, controlling security and order; and preventing crimes in the area.

This force is equipped with support tools, using public measures combined with disguise to check and handle suspicious subjects and violators on key streets and intersections in the city.

Therefore, the criminal police are authorized to stop vehicles.
