Ministry of Information and Communications organizes Conference to disseminate Decree 82/2024/ND-CP

At the Conference, Deputy Minister Pham Duc Long said that Decree No. 82/ND-CP is a difficult decree, and during the drafting process, it received comments from many ministries, branches and localities. In the context of strong growth in investment in information technology (IT) applications using the State budget, Decree 82/ND-CP was amended and issued in a timely manner along with the Decree of the Ministry of Finance regulating investment capital for IT. These two decrees are expected to create an institution to strongly promote investment in IT applications using the State budget.

Ms. Tran Thi Quoc Hien, Deputy Director of the National Digital Transformation Agency, introduced some new points of Decree 82, contributing to removing many "bottlenecks" in IT application investment for state agencies when implementing strategies, programs, projects, and digital transformation plans. Specifically: Management of popular software, Amendments to remove public regulations on prices for commercial software and IT services available on the market, Regulations on IT equipment, Regulations on approval of information security levels, Testing process of IT products and services; Management of mixed projects and multi-component projects.

Ms. Tran Thi Quoc Hien, Deputy Director of the National Digital Transformation Agency, introduced some new points of Decree 82.

According to Ms. Quoc Hien, the regulation on design plans is considered the biggest amendment in the Decree. If Decree 73 stipulates that for the activities of establishing new, expanding or upgrading technical infrastructure systems, software, databases, it is necessary to establish an outline and detailed estimates for systems with a value of 200 million to 15 billion VND. For systems with a value of over 15 billion VND, a project must be established. The newly issued Decree 82 has removed the limit of 200 million VND and 15 billion VND, and the form of establishing an outline and detailed estimates. Accordingly, the activities of building, upgrading, and expanding information systems, hardware, software, and databases forming the system must be carried out similarly to the project management process using development investment funds. Decree 82 clearly stipulates the order, procedures, and authority to implement regular capital expenditure projects.

Decree 82 also stipulates the determination of budgets for software developed on commercial software, open source code, AI, etc.

At the Conference, delegates from ministries, branches and localities discussed and asked more questions related to Decree 82, including: Procedures and appraisal of IT application projects, technical design, use of funds for investment and system operation activities, handling of service lease contracts and operating costs after the project ends, determining the source of capital to maintain the interconnected system from the Central to the local level. Deputy Minister Pham Duc Long and representatives of the National Digital Transformation Agency directly answered, clarified and provided more information on the contents that the delegates were interested in.

Representatives of the Ministry of Transport discussed the content related to Decree 82.

Concluding the Conference, Deputy Minister Pham Duc Long highly appreciated the full presence of representatives of local ministries and branches at today's Conference.

The Deputy Minister said that this is a difficult issue, and that the Law on Information Technology must be amended in the near future to create a more open legal corridor, helping to resolve current problems. Today's conference answered many of the delegates' questions. The Ministry hopes to continue listening to opinions from local ministries and branches to be able to resolve difficulties within its capacity and scope.

In the near future, the Ministry will deploy 2 Circulars detailing this Decree. The Deputy Minister requested that ministries, branches and localities carefully study and propose so that the Ministry of Information and Communications can accompany and support in resolving difficulties and problems.

Finally, the Deputy Minister requested that ministries, branches and localities continue to give their opinions. If there are any concerns or unclear issues, they should be sent to the National Digital Transformation Department for synthesis and answers./.
