Supplementing regulations on management and evaluation of cadres and civil servants according to job positions

The management of cadres and civil servants will take job positions as the center, as the basis for screening, restructuring, and improving the quality of the team when implementing the arrangement and streamlining of the organizational apparatus.

The Ministry of Home Affairs is drafting the Law on Cadres and Civil Servants (amended). In the draft law expected to be submitted to the National Assembly at the upcoming 9th session, the Ministry of Home Affairs proposes to add a separate chapter on job positions, which provides the concept of job positions, classification of job positions; basis for determining job positions; changes to job positions and management content of job positions.

Job position is central in the management of cadres and civil servants.

According to the Ministry of Home Affairs, the State will implement a mechanism for managing cadres and civil servants according to job positions, taking job positions as the center in the management and use of cadres and civil servants as a basis for screening, restructuring, and improving the quality of the team when implementing the arrangement and streamlining of the political system's apparatus.

Regarding the concept of job position, the draft proposes two options. Option 1 is that job position is the name that identifies the tasks of a specific job associated with a professional title or leadership or management position, built on the basis of the functions, tasks and organizational structure of the agency, organization, or unit, and is the basis for recruiting, using, and managing the team.

Option 2 is that a job position is the name of a professional or technical civil servant title or a leadership or management position, associated with work and position in an agency, organization, unit, tasks, responsibilities, authority and specific results and products.

The structure of a job position includes: Name; job description; responsibilities, tasks, authorities; competency framework (knowledge, skills, ability to meet the job...).

To classify job positions, the Ministry of Home Affairs proposes 4 job positions including: Officer; leader, manager; professional, technical; support, service.

The basis for determining job positions is based on the functions, tasks, powers, and organizational structure of the agency, organization, or unit; the level of complexity, nature, characteristics, and scale of operations; the scope and objects of service; and the professional and technical management process according to the provisions of specialized laws.

In addition, determining job positions is also based on the level of office modernization, equipment, working means, application of information technology, and digital transformation.

In addition, local agencies and organizations determine job positions based on geographical location; nature, scale, and population structure; economic growth and urbanization rate; socio-economic development strategy; and local security and order situation.

The Ministry of Home Affairs also clearly stipulates that changes must be based on the job position needs of the agency, organization, or unit and must meet the standards and conditions of the new job position.

The agency or organization managing civil servants shall issue regulations on methods and content of examinations to organize examinations and assessments of civil servants in order to arrange and assign them to job positions suitable to their capacity and qualifications according to the job position.

Manage according to the principle of "in comes out, up comes down"

The draft of the Ministry of Home Affairs also stipulates the competent authorities to guide, decide, approve, adjust and change job positions.

In particular, the Ministry of Home Affairs proposed regulations on methods and content of testing and assessment to organize testing and assessment of civil servants to arrange and assign them to job positions suitable to their capacity and qualifications according to the principle of "some in, some out, some up, some down."

The draft clearly states that the evaluation, arrangement and use of cadres and civil servants must be based on political qualities, ethics, capacity and performance of tasks according to the job position requirements of cadres and civil servants.

In case of not meeting the standards and conditions required by the job position, the competent authority shall consider and decide on streamlining according to the provisions of law at the time of streamlining.

According to the Ministry of Home Affairs, the principle of determining job positions must be consistent with the organizational structure and operations of agencies, organizations and units with similar functions and tasks; ensure scientific, objective, public, transparent, democratic and practical compliance; ensure consistency and synchronization in the recruitment, arrangement, use and management of cadres and civil servants according to job positions.
