Ministry of Education and Training requests report

The Ministry of Education and Training has just issued an official dispatch responding to the organization and operation of Kinh Bac University, located in Bac Ninh City, Bac Ninh Province.

The Ministry of Education and Training said it had received a petition from Ms. Nguyen Thi Tuyet Hong, Mr. Doan Xuan Tiep and related individuals and organizations reflecting and recommending on the organization and operation of Kinh Bac University.

In carrying out its responsibility for state management of education, the Ministry of Education and Training has worked with relevant parties to verify information about the organization and operation of Kinh Bac University. Based on the reports and supporting documents provided by relevant parties up to October 16, 2024, the Ministry has made a number of comments.

The dismissal of Mr. Doan Xuan Tiep as Chairman of the University Council, the dismissal of Ms. Nguyen Thi Tuyet Hong as Vice Chairman of the University Council, the recognition of Ms. Nguyen Thi Tuyet Hong as Chairman of the University Council, and the addition and replacement of other members of the University Council of Kinh Bac University from December 2023 to present have not been carried out in accordance with the procedures prescribed in Article 8 of Decree No. 99/2019/ND-CP dated December 30, 2019 of the Government, detailing and guiding the implementation of a number of articles of the Law amending and supplementing a number of articles of the Law on Higher Education and the Regulations on organization and operation of Kinh Bac University issued together with Decision No. 03/QD-HDT dated August 15, 2020 of the University Council of Kinh Bac University.

The dismissal of Mr. Nguyen Van Hoa from the position of President of Kinh Bac University and the assignment of Ms. Dao Thi Bich Thuy to be in charge of and manage all activities of Kinh Bac University did not comply with the procedures prescribed in Article 16a of the Law on Higher Education 2012 (amended and supplemented in 2018), Clause 5, Article 8 of Decree No. 99/2019/ND-CP and the Regulations on organization and operation of Kinh Bac University issued together with Decision No. 03/QD-HDT dated August 15, 2020 of the Council of Kinh Bac University.

The Ministry of Education and Training requests that investors, the school board, and the Principal of Kinh Bac University review, self-inspecte, revise, supplement, replace, revoke, and abolish documents issued without proper procedures, without proper authority, and without proper regulations on personnel standards as prescribed by law.

The Ministry requires individuals who are appointed or assigned tasks not to perform tasks according to the appointment or assignment decision that are not in accordance with the provisions of law. Related groups and individuals are responsible before the law for performing tasks and exercising powers contrary to the provisions of law, affecting the legitimate rights and interests of learners and related organizations and individuals according to the provisions of law; promulgate regulations on organization and operation; carry out procedures for establishing and recognizing the school council; carry out recognition, dismissal, and removal of the chairman of the school council and supplement and replace other members of the school council; carry out recognition, dismissal, and removal of the President of Kinh Bac University in accordance with the provisions of the Law on Higher Education 2012 (amended and supplemented in 2018), Decree No. 99/2019/ND-CP and related legal documents.

For matters not under the state management of the Ministry of Education and Training (such as financial disputes, assets, investments, capital contributions, use of seals, labor relations... at Kinh Bac University), organizations and individuals are requested to propose and make recommendations to competent authorities for settlement in accordance with the provisions of law.

The fact that Kinh Bac University does not comply with the provisions of law on organization and operation is the responsibility of the investors and the Council of Kinh Bac University. Therefore, the Ministry of Education and Training requests that the investors and the Council of Kinh Bac University urgently take measures to stabilize the organization and operation, and complete the organizational structure and personnel in accordance with the provisions of law.

The Ministry of Education and Training requests Kinh Bac University to report in writing with evidence on the implementation of the above contents and send it to the Ministry before November 15, 2024.
