Two illegal decisions

On September 11, 2024, Dai Doan Ket Newspaper published an article "Ha Tinh: Principal disciplined accountant, teachers' salaries were delayed?" , reflecting on the fact that Principal of Son Ham Kindergarten Tran Thi Thanh Thuy issued a decision to discipline accountants, causing teachers in the whole school to have their salaries delayed in August 2024.

Specifically, on August 23, 2024, Principal of Son Ham Kindergarten Tran Thi Thanh Thuy issued Decision No. 74/QD-MNSH on disciplining accountant Nguyen Thi Thanh Nhan. The form of discipline is "warning - reduction of 1 salary level (from level 5, coefficient 3.34 to level 4, coefficient 3.03) from August 23, 2024. The disciplinary period is 12 months from the effective date of the disciplinary action.

According to Dai Doan Ket reporter's investigation, on August 26, 2024, this principal continued to issue Decision No. 75/QD-MNSH, disciplining accounting officer Nguyen Thi Thanh Nhan. This decision replaces Decision No. 74/QD-MNSH dated August 23, 2024.

The form of discipline stated in Decision No. 75/QD-MNSH is “reduction of one salary level (from level 5 coefficient 3.34 to level 4 coefficient 3.03) from August 26, 2024”. The disciplinary period is 6 months.

Up to this point, accountant Nguyen Thi Thanh Nhan has received her salary for August and September 2024. Of which, the salary for August 2024 received at Son Ham Kindergarten, the salary coefficient was reduced to 3.03 as per Decision 74/QD-MNSH.

On September 10, 2024, Ms. Nguyen Thi Thanh Nhan was transferred to Son Giang Kindergarten. Her salary here was not subject to Disciplinary Decision No. 74/QD-MNSH but restored to a coefficient of 3.34.

Speaking to reporters, Mr. Dao Xuan Hung - Director of Huong Son State Treasury said that the unit received the August 2024 salary table of Som Ham Kindergarten, in which the salary coefficient of accountant Nguyen Thi Thanh Nhan was reduced, the reason was to apply Disciplinary Decision No. 74/QD-MNSH.

In performing its control role, the Huong Son State Treasury discovered that Disciplinary Decision No. 74/QD-MNSH of Son Ham Kindergarten was contrary to the provisions of Decree 112/2020/ND-CP of the Government on disciplinary action against cadres, civil servants, and public employees and the 2010 Law on Public Employees.

According to Article 15, Decree 112/2020/ND-CP, there is no disciplinary form of "demotion" and according to Article 56, Law on Civil Servants, if an official is reprimanded, the salary increase period will be extended by 3 months; if he is warned, the salary increase period will be extended by 6 months.

“According to regulations, if the inspection finds any errors, the unit must refuse to pay. However, considering that the incident of an individual affected the collective, causing dozens of teachers to have their salaries delayed, the unit has asked for the opinion of the State Treasury of Ha Tinh province and sent a document to the People's Committee of Huong Son district requesting inspection and handling. The People's Committee of Huong Son district will be responsible for clarifying, after which the unit will have a plan to pay compensation to accountant Nguyen Thi Thanh Nhan,” said Mr. Dao Xuan Hung.

In fact, the incorrect content in the disciplinary decision was pointed out by accountant Nguyen Thi Thanh Nhan in a petition sent to Ms. Tran Thi Thanh Thuy - Principal of Son Ham Kindergarten on September 4, 2024. However, the principal ignored it and claimed that her disciplinary decision was in accordance with the regulations.

In another development, the leader of the People's Committee of Huong Son district said that after Dai Doan Ket newspaper reported, the district had established a working group to inspect, verify, and clarify the process and decision to discipline officials of the Principal of Son Ham Kindergarten. The inspection process determined that the two decisions mentioned above were against regulations, and the unit would revoke the two decisions that violated regulations.

Need to consider carefully

Receiving feedback about the delay in salary for all staff, teachers and employees, on September 9, Dai Doan Ket reporter went to Son Ham Kindergarten and contacted Ms. Tran Thi Thanh Thuy to find out the matter.

The reporter presented her documents to introduce herself and schedule a meeting, but Ms. Tran Thi Thanh Thuy brushed them aside and did not look at them. Although she admitted that she “had delayed her salary,” she did not explain the reason and refused to answer the reporter’s questions or arrange a meeting schedule.

On September 11, after the article "Ha Tinh: Principal disciplined accountant, teachers' salaries were delayed?" published by Dai Doan Ket Newspaper, many responses were received from people in Son Ham commune, Huong Son district, expressing their concern about this incident and hoping that the district would intervene to thoroughly and completely resolve it.

Even on social networks, through the Facebook account "Thanh Thuy Tran", this person openly criticized the leaders of the education sector and the leaders of Huong Son district.

It is time for the Standing Committee of the District Party Committee, the District People's Committee, the education sector of Huong Son district and Ha Tinh province to consider with compassion and reason the manifestations and actions of the Principal of Son Ham Kindergarten, Tran Thi Thanh Thuy.
