Building a legal program that adheres to '2 requirements' and '3 guarantees'
The Ministry of Industry and Trade has just issued Official Dispatch No. 10839/BCT-VP notifying the direction of the Minister of Industry and Trade on thoroughly grasping and implementing the Conclusion of General Secretary To Lam on changing thinking in the work of building and enforcing laws.

The dispatch clearly stated that, considering the proposal of the Legal Department in Report No. 3272/PC-TH dated December 18, 2024 on the content of the national conference on judicial work in 2024, in order to thoroughly grasp and seriously implement the conclusion of General Secretary To Lam on the transformation of thinking in the work of building and enforcing laws in Notice No. 108-TB/VPTW dated November 18, 2024 of the Central Office of the Party, the Minister of Industry and Trade requested relevant units, according to their assigned functions and tasks, to focus on and effectively perform the assigned tasks.
In particular, the Legal Department disseminates and thoroughly disseminates to Party committees and leaders of units under the Ministry with functions and tasks related to law-making the full text of General Secretary To Lam's direction on transforming thinking in law-making and enforcement, focusing on 3 contents such as: First , the development of the annual Law Program must closely follow the '2 requirements', and at the same time must fully implement the '3 guarantees'; Second , it is necessary to "consider the leadership of institutionalizing the Party's policies and guidelines into laws and leading the work of law enforcement to ensure the supremacy of the Constitution and laws as the central and regular tasks of Party committees, Party organizations, and each Party member".
Third , regularly evaluate the effectiveness of laws after promulgation, promote the application of technology and build effective mechanisms to proactively detect and quickly remove bottlenecks caused by legal regulations. Based on the General Secretary's guiding viewpoints and practical requirements of the Industry and Trade sector to complete and submit to the Party Executive Committee, the Minister decides to promulgate the Program for drafting legal documents of the Ministry of Industry and Trade in 2025 and other related Work Programs in 2025.
Developing human resources for law-making work
The official dispatch of the Ministry of Industry and Trade also requires the Heads of units under the Ministry of Industry and Trade to closely follow the direction of General Secretary To Lam in the work of building and implementing laws. In addition, thoroughly implement the following contents: Developing human resources for legal advisory work. Increasing investment resources, having a specific financial mechanism for policy research and law making, meeting increasingly high political tasks in the new era; modernizing the working environment and conditions so that the team of cadres and civil servants advising on law making can work with peace of mind and dedicate themselves to the common cause. Researching and proposing appropriate mechanisms to attract high-quality human resources for law making work.
Handling legal issues arising in the process of international integration, focusing on "Enhancing the role of the Ministry of Justice in participating in the development of international institutions and laws, enhancing the responsibility for preventing and resolving international investment disputes, effectively handling legal issues arising in the process of international integration, promptly protecting national interests, legitimate rights and interests of individuals, organizations, and state agencies of Vietnam".
The directive document of the Minister of Industry and Trade also requires the Department of Planning and Finance to advise the leaders of the Ministry of Industry and Trade to consider and arrange adequate and appropriate human resources for law-making and legal work in all units within the Ministry, especially for the Projects on legal work approved and issued by the Minister of Industry and Trade. |
