The People's Court of Hai Ba Trung District (Hanoi) will hold a mediation session in the case of Mr. Duong The Hao suing the National Economics University for compensation of 36 billion VND for keeping his bachelor's degree and many documents for 30 years.
Judge Phan Thanh Ha - Hai Ba Trung District People's Court, Hanoi has just announced a meeting to review the submission, disclosure of evidence and mediation of the case in which Mr. Duong The Hao (residing in Vinh Hung Ward, Hoang Mai District, Hanoi) filed a lawsuit, requesting the National Economics University to compensate over 36 billion VND.
After reviewing the documents and evidence in the civil case file and based on the provisions of the Civil Procedure Code, the Hai Ba Trung District People's Court believes that the case is not a case that cannot be mediated. Therefore, according to the court, holding a public meeting to disclose evidence and mediated is necessary for the resolution of the case. The mediated session will take place on the morning of December 17 at the headquarters of the Hai Ba Trung District People's Court.
The court notice was sent to Mr. Duong The Hao and the National Economics University - the legal representative is Mr. Pham Hong Chuong, principal.

The notice also clearly states that if the notified person does not appear at the correct time and place stated in this notice to participate in the meeting and mediation, the court will continue to resolve the case according to the provisions of the civil procedure law.
Previously, the Hai Ba Trung District People's Court announced that it had accepted a civil case requesting compensation for non-contractual damages, according to the lawsuit filed by Mr. Duong The Hao. The defendant is the National Economics University - the legal representative is Mr. Pham Hong Chuong, the school's principal.
The reason for the lawsuit is that after completing the course, Mr. Hao did not receive his diploma and many important personal documents since 1989. It was only when he filed a lawsuit in court that the school returned his diploma along with his records and personal documents to him in 2019. Mr. Hao requested the National Economics University to pay compensation of 36,696 billion VND.

After Dan Viet newspaper published a series of articles about Mr. Duong The Hao suing the National Economics University for 36 billion VND in compensation, on October 30, responding to Dan Viet reporters , the school representative said: "The school affirms that it does not keep Mr. Duong The Hao's original diploma and documents as he reported to the press.
Regarding the granting of bachelor's degrees and original documents, Mr. Hao filed a lawsuit against the school at the Hanoi People's Court. The Hanoi People's Court issued a first-instance judgment rejecting the plaintiff's requests. The plaintiff continued to appeal to the High People's Court in Hanoi. The High People's Court in Hanoi issued an appeal judgment No. 282/2022/HC-PT dated July 17, 2022 rejecting Mr. Duong The Hao's appeal.

Regarding Mr. Duong The Hao's lawsuit demanding compensation from the National Economics University for damages and losses due to having his bachelor's degree and original documents withheld for a long time, the school representative said: "The school's view is that everything must comply with the provisions of the law. The school respects the right of individuals to sue any organization or individual in accordance with the provisions of the law."
Regarding the school's information as above, talking to Dan Viet , Mr. Duong The Hao reacted: "The school has swapped concepts. The school was forced to return my diploma and all documents to me right in court.
In 2018, the National Economics University sent a document to Mr. Hao stating that Mr. Hao was not named in the Graduation Recognition Decisions and the list of students who were granted degrees being kept in the graduation certificate book, so there was no basis to grant him a degree while he was studying full-time at the school. After that, the Hanoi People's Court issued a decision to suspend the case with a red seal and signature of the Judge - the presiding judge of the trial. If the school says it does not keep the copy, it will return my original diploma and documents to the court."
Specifically, the decision to suspend the settlement of the administrative case of the Hanoi People's Court signed on July 31, 2019 stated: "Considering that at the trial on July 23, 2019, Mr. Duong The Hao withdrew the lawsuit against the action of the President of the National Economics University for not granting him a university degree because at the trial, the President of the National Economics University had awarded the degree to Mr. Duong The Hao.
At the trial on July 31, 2019, Mr. Duong The Hao withdrew his request to sue the Principal of the National Economics University for not returning his personal file because at the trial, the Principal of the National Economics University returned his personal file to Mr. Duong The Hao...".
Mr. Hao also informed that after the civil lawsuit, he will continue to petition the school to correct his diploma. Mr. Hao said that he graduated from university in 1989, while the National Economics University recorded his graduation date as 1994.
In the lawsuit sent to the court, Mr. Hao listed in detail the amounts of money he requested the school to compensate, including: Loss of income from salary of 4.5 billion VND; loss of income outside of salary of 1.5 billion VND; damage to spirit, reputation, and honor of 2.5 billion VND; loss of opportunity to continue studying and improving professional skills of 3.6 billion VND; loss of opportunity to enjoy policies and incentives for veterans of 2.7 billion VND; loss of ownership and disposal of essential assets of 7.5 billion VND.
