Continuing the program of the 6th Session of the 15th National Assembly, on the morning of October 25, the National Assembly discussed in the hall a number of contents with different opinions of the draft Law on Identification.
Reporting on the explanation, acceptance and revision of the draft Law on Identification, Chairman of the National Assembly's Committee on National Defense and Security Le Tan Toi said: The National Assembly Standing Committee agreed with the majority of opinions approving the name of the Law on Identification and the name of the identification card. Because the use of the name Law on Identification clearly demonstrates the scientific nature, will cover the scope of regulation, the subjects of application of the Law including Vietnamese citizens and people of Vietnamese origin living in Vietnam but whose nationality has not been determined, consistent with the nature and objectives of identity management of our State; consistent with the management method in the period of the 4.0 revolution, building a digital government, a digital society. Using the name of the identification card as in the draft Law is appropriate, will fully cover information about citizens' identities.
Member of the National Assembly Standing Committee, Chairman of the National Assembly's Committee on National Defense and Security Le Tan Toi presented a report explaining, accepting and revising the draft Law on Identification.
Regarding identity certificates and management of people of Vietnamese origin, accepting the opinions of National Assembly Deputies, the National Assembly Standing Committee directed to move this Article to Chapter III (Article 30), rename Chapter III to “Identification cards, identity certificates” and supplement and revise Article 5 “Rights and obligations of Vietnamese citizens and people of Vietnamese origin whose nationality has not been determined regarding identity, National Population Database and Identity Database”, comprehensively revising this Article as the draft Law accepted and revised to provide more specific and clear regulations on people of Vietnamese origin whose nationality has not been determined.
Regarding citizen information in the National Population Database and information in the Identification Database, Chairman of the National Defense and Security Committee Le Tan Toi said that some opinions suggested carefully considering and evaluating the information added to the National Population Database and the Identification Database to ensure the confidentiality of the information.
According to the National Assembly Standing Committee, to implement Project 06, it is necessary to expand and integrate more information of citizens and people of Vietnamese origin whose nationality has not been determined in specialized databases into the National Population Database and the Identification Database; at the same time, the draft Law stipulates that only information fields that are clearly defined in management practice, frequently used, and needed in the National Population Database will be updated. Among the information fields specified in this Article, there are 7 information fields that people must provide if these information fields do not exist or are incomplete.

Regarding the content shown on the ID card, the Standing Committee of the National Assembly believes that the information shown on the ID card has been specifically assessed, ensuring no duplication between information fields, consistency between the types of popular identification documents currently used by citizens, and compatibility with relevant legal regulations; at the same time, to create more convenience for people in the process of using the ID card; integrating both QR code and electronic chip on the ID card aims to create favorable conditions for agencies, organizations, and individuals to exploit and use citizen information when performing administrative procedures and civil transactions.
Regarding the integration of information into the ID card, accepting the opinions of National Assembly Deputies, the National Assembly Standing Committee directed to transfer the content of paragraph 2, clause 3, Article 22 to Article 33, which only stipulates when there is a difference between the information on the ID card and the information in the electronic ID; does not require comparison and cross-checking of information in all cases.
Regarding the issuance and management of electronic identification cards, based on the opinions of National Assembly Deputies, the National Assembly Standing Committee directed the revision of Clause 12, Article 3 on “electronic identity of Vietnamese citizens”, omitted Article 32 of the draft Law and revised Clause 2, Article 31 of the draft Law to more clearly demonstrate the relationship between “electronic identity” and “electronic identification”; revised the concept of electronic identification card in Clause 16, Article 3; added 3 clauses in Article 31 to more specifically stipulate the information in electronic identification cards, the authority to issue electronic identification cards and assigned the Government to prescribe the procedures for issuing electronic identification cards; revised the name of Article 33 to “Use value of electronic identification cards”, omitted Clause 2, Article 33, moved this content to Article 34 and designed into Clause 5 assigning the Government to prescribe the procedures for locking and unlocking electronic identification cards as accepted and revised in the draft Law.

Regarding the effective date, Chairman of the National Defense and Security Committee Le Tan Toi said that, based on the report and proposal of the Drafting Committee, the Standing Committee of the National Assembly found that, basically, by July 1, 2024, the provisions of the Law can be implemented synchronously, uniformly and in accordance with the provisions of relevant laws as well as the arrangement and adjustment of administrative units in the coming time; there is no content that needs to be regulated to take effect in advance. However, the Standing Committee of the National Assembly requested the Government to review and invest in basic, effective, and complete technical infrastructure so that the exploitation and use of the national identification application can be effective.
Regarding transitional regulations, currently, the National Population Database has been connected with 13 ministries, branches and 63 localities; the connection and exploitation of the National Population Database serves many activities in all areas of social life; at the same time, nearly 80 million citizen identification cards have been issued to eligible citizens. Therefore, the regulation on the expiration date of the citizen identification card from December 31, 2024 basically does not have a major impact on people's transaction activities.
