Continuing the working program, on March 26, at the National Assembly House, the Conference of full-time National Assembly deputies discussed the draft Law on Corporate Income Tax (amended). During the morning session, under the direction of Vice Chairman of the National Assembly Nguyen Duc Hai, the deputies gave their opinions on the draft Law on Corporate Income Tax (amended).


According to delegate Hoang Van Cuong (Hanoi delegation) and some other delegates, the regulation that only allows enterprises to enjoy incentives during the remaining time of the project when expanding investment can make many enterprises "afraid" to develop, even delaying expansion investment until the end of the project to enjoy maximum incentives. Therefore, it is necessary to change the method of calculating incentives based on the ratio of expansion investment capital compared to the total investment capital in direct proportion. Specifically, the higher the ratio of expansion investment capital, the longer the enterprise will receive incentives compared to the remaining time of the project.

Regarding the unfeasible provisions in the draft Law, delegate Trang A Duong (Ha Giang delegation) commented: the regulation of not recording expenses and business income for expenses that do not meet the conditions and content of expenses according to specialized laws will more or less cause difficulties for both taxpayers and tax officials.

Delegates said that requiring tax officials to review all relevant specialized legal regulations would cause overload, leading to a prolonged inspection process and wasting time to obtain confirmation from specialized agencies. Not only that, self-assessment of unconfirmed expenses also poses a risk of misapplication, causing damage to taxpayers.

Delegate To Ai Vang (Soc Trang delegation) stated: The regulation on tax incentives for enterprises investing in and regularly employing over 6,000 workers is too high and unreasonable, creating unnecessary pressure on enterprises investing in localities with low investment rates. The drafting committee needs to consider and study amendments in the direction of reducing the minimum number of workers that enterprises regularly employ.

One of the issues that delegates were interested in at the working session was the regulation on additional tax incentives for the press sector. According to delegate Thach Phuoc Binh (Tra Vinh delegation), the proposal of the drafting agency to reduce the tax rate from 20% to 10% for printed newspapers and from 20% to 15% for other types of press is likely to cause conflicts between tax policy and the practical activities of the press, especially in the context of the increasing dominance of electronic newspapers, many newsrooms have had to cut or stop publishing paper newspapers.

During the working session in the afternoon of the same day, under the direction of Vice Chairwoman of the National Assembly Nguyen Thi Thanh, delegates expressed high consensus on the draft Law amending and supplementing a number of articles of the Law on Advertising.

The Draft Law amending and supplementing a number of articles of the Law on Advertising was discussed at the 8th session of the 15th National Assembly and then continued to be commented on at the 41st session of the National Assembly Standing Committee.

Vice Chairwoman of the National Assembly Nguyen Thi Thanh said: Regulations on the rights and obligations of those who deliver advertising products are the content that has received the most comments, especially after the incident in which some celebrities were administratively fined and forced to correct information due to false advertising of vegetable candy products. Regarding regulations on cross-border advertising, the draft Law is revised in the direction of establishing this as a type of advertising that needs to be managed, requiring related entities to comply with tax obligations and Vietnamese law.

From now until the 9th session of the 15th National Assembly, scheduled to open in May, the Ministry of Culture, Sports and Tourism will complete the dossier, report to the Government for official comments, and send the dossier to the National Assembly Standing Committee and the reviewing agency to complete before submitting it to the National Assembly. Vice Chairwoman of the National Assembly Nguyen Thi Thanh requested the Ministry of Culture, Sports and Tourism as well as the reviewing agency to study and review carefully, especially the regulations related to state management of the policy of merging, streamlining the apparatus, and organizing two-level local governments to update new developments.
