Falling into the trap of brokers, people lose land, authorities tighten management

Faced with the situation of many people being cheated out of their land, local authorities in Dak Lak province have issued warning documents and tightened management to prevent the tricks of land brokers.

On March 24, Mr. Nguyen Tien Truong - Chairman of the People's Committee of Ea Drong commune (Cu M'gar district, Dak Lak) - said that the locality has issued a warning document and tightened management to prevent the tricks of "brokers" that cause people to lose land, prolong disputes and disrupt security and order.

Lost land because of believing the broker

This warning was issued in response to the situation where many households in Ea Drong commune lost their land because they believed in the promises of "brokers", causing disputes and loss of security and order.

Mr. YP (residing in Yong B hamlet, Ea Drong commune) put up a "land dispute" warning sign on his family's land plot of more than 1,000 square meters because he had not received enough money after selling the land in 2020.

The buyer only paid a deposit of 200 million VND, borrowed the pink book with the excuse of editing the information and then sold it to someone else. When he discovered that the land had been transferred, he contacted them but did not receive any more money, forcing him to file a lawsuit.

Similarly, Mr. YK sold 2,400m² of land for 2.4 billion VND, received 900 million VND in advance, but the buyer borrowed the red book, secretly transferred the name and continued to sell it. The buyer also forged a land donation contract to legalize the transfer of name.

"My wife and I are illiterate and did not understand all the documents so we signed them. Now the land has been transferred to someone else's name without receiving the full payment," Mr. YK lamented.

This situation is common when land brokers deposit a small amount to create trust, then borrow the red book to complete the procedures. People are asked to sign documents, from power of attorney to land use right donation contracts, without fully understanding the content.

Taking advantage of this, land brokers quickly transferred the red book title, even transferred valuable residential land to others to resell at a higher price. Many households lost their residential land, their only asset.

Government warning

Chairman of the People's Committee of Ea Drong commune, Mr. Nguyen Tien Truong, said that this situation began to appear after the land "fever" in the period of 2020 - 2021, especially when information about the planning of Phu Xuan Industrial Park appeared.

Faced with this reality, the Commune People's Committee issued a warning document and advised people not to hand over the red book before receiving the full payment and not to sign a land sale contract without clearly verifying the information with the authorities.

"People need to be careful and not rush to sign documents without fully understanding the content. The government will strictly handle violations of land laws, especially illegal subdivision and sale of land and illegal conversion of land use purposes," Mr. Truong emphasized.

In addition, in some cases, after selling the land, the "brokers" transferred the entire residential land to the buyer's red book. When the people handed over the book and signed the authorization to separate the land, the "brokers" took advantage of this to transfer the entire residential land area, causing them to not retain the original residential land.

The situation of losing residential land due to unclear transactions occurs in many other localities of Cu M'gar district, especially Cu Sue and Cuor Dang communes.

Mr. Dang Van Hoan - Chairman of the People's Committee of Cu Sue Commune - said that many people in this commune had previously fallen into a similar situation. When selling land, they handed over the red book, authorized a "broker" to do the procedures for dividing the plot, but the residential land was transferred to a new red book and sold to someone else at a higher price.

"Because people signed the documents without fully understanding the content, many disputes have not been completely resolved. The government recommends that when people want to buy or sell land in the locality, they should contact the authorities to verify planning and legal information, to avoid prolonged disputes," Mr. Hoan informed.
