Regarding connection and data sharing, National Assembly delegate Nguyen Minh Tam (Quang Binh) commented on the connection and sharing of telecommunications infrastructure to overcome the situation of "your rights, my rights". The delegate suggested that the draft law should also provide more specific and detailed regulations on cases of connection and sharing of telecommunications infrastructure.

On June 22, the National Assembly discussed in the hall the draft Law on Telecommunications (amended).

Remove monopoly

Delegate Nguyen Thi Ngoc Xuan (Binh Duong) proposed that telecommunications infrastructure business should be added to the form of telecommunications business. In fact, there has been an expansion of the subjects of passive telecommunications infrastructure investment, not only telecommunications enterprises but also other organizations and individuals.

This is a development trend, many organizations and individuals have the need to use technical infrastructure rented from other suppliers to serve the development of business activities on telecommunications platforms. The delegate suggested that this content should be legalized for strict management.

According to the deputies, voters said that some enterprises holding telecommunications infrastructure have not created favorable conditions for other enterprises to participate in shared use or have set prices many times higher than the recommended unit prices. "This can easily lead to a monopoly situation," said Deputy Nguyen Thi Ngoc Xuan.

From there, the delegate proposed to add to the draft law to strictly manage the telecommunications system and manage the rental price of shared telecommunications infrastructure to promote synchronous development in this field.

Currently, telecommunications enterprises licensed by the Ministry of Information and Communications have inter-provincial or nationwide scope of operation, but there are no strict regulations binding enterprises when implementing infrastructure investment projects and providing services in other provinces and cities.

Faced with this reality, the delegate recommended that it is necessary to study and supplement regulations on licensing and operating conditions when establishing telecommunications infrastructure.

Accordingly, it is necessary to stipulate that enterprises operating telecommunications activities on a large scale when deploying services and technical infrastructure works in different localities must have offices or representatives and technical staff.

According to the delegate, this is to closely coordinate with state management agencies in solving issues related to local telecommunications infrastructure.

At the same time, there needs to be appropriate policies for the task of sharing telecommunications infrastructure. For telecommunications infrastructure invested by corporations and enterprises, when requested to share by competent authorities, there needs to be preferential policies on finance and taxes for enterprises...

Junk SIMs "terrorize" people

Delegate Le Xuan Than (Khanh Hoa) commented on regulations on illegal collection, eavesdropping, and viewing of personal information on telecommunications.

Regarding the rights and obligations of telecommunications service agents, Deputy Duong Van Phuoc (Quang Nam) proposed adding regulations allowing connection to the National Population Database of the Ministry of Public Security.

This helps standardize subscriber information to match the current situation. Thereby overcoming the situation of junk SIMs and anonymous SIMs to "terrorize" customers, affecting the legitimate rights of people, organizations and businesses.

Regarding the obligations of telecommunications enterprises, the delegate also proposed not to provide telecommunications services with rates lower than cost, except in cases serving national defense, security, education, and health tasks to ensure social security.

According to the delegate, recently voters have repeatedly reported on the situation of telecommunications cables, cable TV, and internet cables arranged on roads, which are unsightly and pose a potential safety risk.

According to the delegate, the main reason is that these service providers are irresponsible, do not collect unused cables, and the construction does not ensure urban aesthetics.

The delegate suggested that there should be regulations on the responsibility of telecommunications enterprises to reclaim telecommunications works, including telecommunications technical infrastructure, when they are no longer in use.

At the same time, there are sanctions to strictly manage cases where telecommunications enterprises install equipment that does not meet technical requirements or does not ensure urban aesthetics...

Regarding the Vietnam Public Telecommunications Service Fund, Deputy Nguyen Dinh Viet (Cao Bang) suggested that the law drafting agency consider not continuing to maintain the Vietnam Public Telecommunications Service Fund to avoid wasting resources.

According to the Delegate, the fund's operational efficiency is limited, while maintaining its operations still has many shortcomings. The fund's surplus for the 2016-2022 period is up to VND5,427 billion.
