Project is more than 20 years behind schedule
Accordingly, the Project to Create Urban Land Fund for the City, along Nguyen Huu Tho Street (in Phuoc Kien Commune and Nhon Duc Commune, Nha Be District) is the first project to create clean land fund with the purpose of auctioning land use rights, handing over land use rights to investors with the capacity to quickly implement the city's investment projects according to the approved planning.
This project is expected to create momentum to promote urbanization, form residential areas, commercial service areas, public works, modern public works contributing to the economic growth of Nha Be district in particular and Ho Chi Minh City in general, while contributing to improving the quality of life of the people.
However, during the implementation process, there have been problems, shortcomings and violations related to land acquisition, compensation, support and resettlement for people and in the management and use of project land after acquisition.

Specifically, the project has been behind schedule compared to the approved schedule (investment progress is the period 1999 - 2000), up to now the compensation, support, and land recovery have not been completed. Of which, 38 cases have not agreed to receive compensation and support at the project and 22/38 cases have not agreed to hand over the site but Nha Be District People's Committee has not yet enforced land recovery according to regulations. The implementing units have not yet fully implemented the volume of investment items approved by Ho Chi Minh City People's Committee.
The above shortcomings have affected the effectiveness of land management and use, and the progress of construction investment in projects approved for investment by competent authorities.
In addition, the implementation of the policy of additional support for purchasing apartments has been delayed due to the fact that the investor assigned to invest in building the apartment building, Dong Mekong Company, has been slow to complete the construction investment, affecting the rights and legitimate interests of people whose land has been recovered (now more than 20 years), potentially causing complaints and denunciations from people. It is necessary to soon have a fundamental and feasible solution to resolve it completely.
Many problems in the process of land management are recovered.
The inspection conclusion also pointed out that the Nha Be District People's Committee's Decision to approve the detailed planning project at a scale of 1/500 in 7 sub-areas in areas without a 1/2000 planning plan and without a planning permit is not in accordance with the prescribed procedures.
The Department of Planning and Architecture has a document on the results of the appraisal of the detailed urban construction planning project at a scale of 1/2000 (land use and traffic planning), accordingly appraising the planning land on the left side of Nguyen Huu Tho Street, including the land of District 7, but requesting the People's Committee of Nha Be District to consider and sign the approval of the planning is beyond the authority of the district.
In addition, almost all of the land recovered in this project has been granted land use right certificates to investors by the Department of Natural Resources and Environment. However, up to now, some places have not completed the site clearance and land recovery work, and have not completed the adjustment or revocation of land use right certificates of the households whose land was cleared.
This is an area with rapid urbanization with many projects.
The land management of Nha Be District People's Committee and investors is still loose, leading to the situation where some people and other units have not yet handed over the recovered land or encroached on the land for personal use, business profit, etc.
The land plots with 1/2000 planning are planned roads, located between the subdivisions of the land plot on the left side of Nguyen Huu Tho Street. Up to now, it is unclear which unit is responsible for management and investment in construction, leading to unsynchronized investment, affecting the landscape architecture of the entire road, not in accordance with the approved 1/2000 planning.
In the land plot on the left side of Nguyen Huu Tho Street, the relevant state management agencies and project investors have many shortcomings, defects, and violations in the process of land management, land use, and implementation of construction investment projects. In particular, in some subdivisions, although land has been allocated for many years, investors have not yet invested in construction, have not fenced, left the land vacant, and abandoned, causing waste of land resources....
Regarding financial obligations, the Inspection Conclusion also mentioned the implementation of the obligation to pay the auction winning money for the land plot on the left side of Nguyen Huu Tho Street. In which, the consortium of 3 units and Phu Long Company paid the auction money for land use rights behind schedule compared to the prescribed time.
In this Conclusion, the Inspectorate recommends that the Chairman of the City People's Committee direct the Management Board of Traffic Construction Investment Projects to preside over and coordinate with Nha Be District People's Committee and relevant agencies to develop a plan to continue to urgently implement the correction of related shortcomings and violations in the Project to speed up the completion progress and carry out payment and settlement in accordance with regulations, not to prolong...
