From January 1, 2025, drivers who violate traffic laws will have their driving license deducted at least 2 points and up to 10 points, depending on the nature of the violation.


On December 30, information from the Traffic Police Department (CSGT), Ministry of Public Security said that to ensure the implementation of the Law on Road Traffic Order and Safety, the Prime Minister issued Decree No. 168/2024, regulating administrative sanctions in the field of road traffic, deduction of points, and restoration of driving license points.

Decree No. 168/2024 takes effect from January 1, 2025 and replaces Decree 100/2020/ND-CP (amended and supplemented by Decree 123/ND-CP). Compared to previous drafts, the regulations on driver's license point deduction will have some changes.

Violations of alcohol concentration at certain levels will be subject to increased administrative penalties (illustrative photo).

Specifically, one of the notable contents that will soon take effect is that drivers who violate the alcohol concentration exceeding 50mg/100ml of blood or 0.25 mg/l of breath will have their driving license deducted 4 points (instead of having their driving license revoked for 10-12 months as currently applied).

Drivers with alcohol levels exceeding 50-80mg/100ml of blood or exceeding 0.25-0.4 mg/l of breath will have their driving license deducted 10 points (instead of having their driving license revoked for 16-18 months).

For the highest level of alcohol concentration violation exceeding 80 mg/100 ml of blood or exceeding 0.4 mg/l of breath, the driver will have his/her license revoked immediately for 22-24 months and no points will be deducted. Previously, the draft proposed to immediately deduct 12 points from the driver's license.

Article 58 of the 2024 Law on Road Traffic Order and Safety states that driving license points are used to manage drivers' compliance with laws on road traffic order and safety on the road traffic order and safety database system.

A driving license that has not been deducted all points and has not been deducted points within 12 months from the date of the most recent deduction will have all 12 points restored. In case a driving license has been deducted all points, the license holder is not allowed to drive a vehicle on the road under that driving license.

After at least 6 months from the date of all points being deducted, the driver's license holder is allowed to participate in the test on legal knowledge on road traffic order and safety, organized by the Traffic Police, and if the result is satisfactory, all 12 points will be restored.

In addition, after being changed, reissued or upgraded, the driving license will retain the same number of points as the driving license before being changed, reissued or upgraded.

Colonel Nguyen Quang Nhat, Head of the Traffic Police Department's Department of Propaganda, Investigation, and Resolution of Traffic Accidents, added that before January 1, 2025, this agency and the national traffic police force had completed training, developed plans, reviewed and arranged forces and means to propagate to the people and were ready to strictly handle violations.

In particular, the Traffic Police will prioritize the use of surveillance camera systems and body-worn cameras on patrol forces to record images for propaganda, reminders, and handling of traffic participants.

"Regarding the regulation on deducting points from driving licenses, the Traffic Police Department is ready to adapt the software for handling violations and update the regulations in the new decree. At the same time, the databases have been linked and connected to the national database on population," a representative of the Traffic Police Department affirmed.
