Article 6 of the Draft Circular on policies and regimes when arranging and streamlining the organizational apparatus in the Army proposes a method of calculating policy benefits for cases of working at agencies and units directly affected by the arrangement of the organizational apparatus.
These cases include: Subjects specified in Clauses 1, 2, 3, 4 and 5, Article 2 of this Circular who are eligible for early retirement due to organizational restructuring are entitled to policies and regimes specified in Article 7 of Decree No. 178/2024/ND-CP, amended and supplemented by a number of clauses in Clause 6, Article 1 of Decree No. 67/2025/ND-CP.
For cases with remaining age of more than 5 years but reaching 10 years of age limit as guided in Point a, Point b, Clause 5, Article 5 of this Circular, the one-time pension allowance for the number of months of early retirement; allowance for the number of years of early retirement and allowance according to working time with compulsory social insurance payment are proposed as follows:
a) One-time retirement benefits for the number of months of early retirement are implemented as follows:
- Retire within the first 12 months from the effective date of the decision on organizational arrangement of the competent authority:
One-time pension benefit level | = | Current monthly salary as guided in Clause 3, Article 4 of this Circular x 0.9 x 60 months |
- Retirement from the 13th month onwards from the effective date of the decision on organizational arrangement of the competent authority:
One-time pension benefit level | = | Current monthly salary as guided in Clause 3, Article 4 of this Circular x 0.45 x 60 months |
b) The allowance for the number of years of early retirement is implemented as follows:
Benefit level for years of early retirement | = | Current monthly salary as guided in Clause 3, Article 4 of this Circular | x 4 x | Number of years of early retirement as guided in Clause 2, Article 5 of this Circular |
c) Allowances based on working time with compulsory social insurance contributions are implemented according to the instructions at Point c, Clause 1 of this Article . Specifically as follows:
- Receive a subsidy of 5 months of current salary for the first 20 years of work with mandatory social insurance. From the 21st year onwards, for each year of work with mandatory social insurance, a subsidy of 0.5 months of current salary will be provided.
Allowance level based on working time with compulsory social insurance | = | Current monthly salary as guided in Clause 3, Article 4 of this Circular | x | 5 (for the first 20 years of work with mandatory social insurance) | + | 0.5 x | Number of years of work with compulsory social insurance from the 21st year onwards |
- In case of 15 years of work or more, paying compulsory social insurance and being eligible for pension according to the provisions of the law on social insurance at the time of early retirement, the employee will receive a subsidy of 4 months of current salary for the first 15 years of work; from the 16th year onwards, for each year of work with compulsory social insurance payment, the subsidy is equal to 0.5 months of current salary.

Example 01: Comrade Hoang Van Manh, born in July 1978, enlisted in September 1997, rank of Lieutenant Colonel QNCN, staff working at the Military Command of B province. According to current regulations, by July 2032, Comrade Manh will be 54 years old, the highest age limit for active service according to the rank of Lieutenant Colonel QNCN.
In April 2025, Comrade Manh's unit merged with another unit; Comrade Manh was decided by the competent authority to retire early (without retirement preparation) and receive pension from August 1, 2025 (47 years old).
Comrade Manh is eligible to retire within the first 12 months from the effective date of the merger decision of the competent authority; the early retirement period is 7 years (84 months) and has 27 years and 11 months of work with compulsory social insurance contributions. Assuming that Comrade Manh's current salary before retirement (July 2025) is 20,000,000 VND; in addition to enjoying the retirement regime according to the provisions of the law on social insurance, Comrade Manh is also entitled to the following regimes:
One-time pension for the number of months of early retirement is: 20,000,000 VND x 0.9 months x 60 months of early retirement = 1,080,000,000 VND.
One-time allowance for years of early retirement is: 20,000,000 VND x 4 months x 7 years of early retirement = 560,000,000 VND.
One-time allowance for years of work with compulsory social insurance is: 20,000,000 VND x {4 months + (0.5 x 13 years)} = 210,000,000 VND.
The total amount of subsidy that comrade Manh received is: 1,850,000,000 VND.
Example 02: Comrade Hoang Van Manh is the same as in example 01; however, the competent authority decides that Comrade Manh retires before the age limit, with a pre-retirement leave period of 12 months, from August 1, 2025 to July 31, 2026, and will receive a monthly pension from August 1, 2026. In case Comrade Manh retires after the above mentioned period, he will enjoy the policies and regimes of a retired person from the 13th month onwards from the effective date of the merger decision of the competent authority.
Comrade Manh wishes to retire before the end of his retirement period and receive a monthly pension from February 1, 2026, and the competent authority has approved his wish; accordingly, Comrade Manh is eligible to enjoy policies and regimes for retirees within the first 12 months from the effective date of the merger decision of the competent authority.
The Ministry of National Defense is organizing a consultation on the second draft of the Circular on policies and regimes when arranging and streamlining the organizational apparatus in the Army to continue editing and perfecting the document.
This draft Circular has 18 articles, an increase of 6 articles compared to the previous draft circular; expands the scope of application to guide the implementation of policies and regimes for subjects under the management of the Ministry of National Defense in implementing organizational restructuring; streamlining payroll, restructuring, improving the quality of staff; cadres who are not old enough to be re-elected, re-appointed or are eligible for re-election, re-appointed; cadres participating in Party committees at Party committees must end their activities according to the provisions of Articles 7, 8, 9, 10, 11 and 14 of Decree No. 178/2024/ND-CP, Clauses 5, 6, 7, 8, 9, 10 and 11 of Article 1 of Decree No. 67/2025/ND-CP; responsibilities of relevant agencies, units and individuals.
