Nghe An issues land price adjustment coefficient in 2024

At the 20th session (special session), the People's Council of Nghe An province, term XVIII, term 2021 - 2026, agreed with the proposal of the Provincial People's Committee on the land price adjustment coefficient in 2024 in the area.

The approval of the land price adjustment system in 2024 as a basis for determining land use fees and land rents according to the provisions of the Government's Decrees: Decree No. 35/2017/ND-CP dated April 3, 2027 regulating the collection of land use fees, land rents, and water surface fees in economic zones and high-tech zones and Decree No. 12/2024/ND-CP dated February 5, 2024 amending and supplementing a number of articles of Decree No. 44/2014/ND-CP dated May 15, 2014 on land prices, Decree No. 10/2023/ND-CP dated April 3, 2023 amending and supplementing a number of articles of the decrees guiding the implementation of the Land Law.

Accordingly, for agricultural land, the land price adjustment coefficient (K) is K=1; for non-agricultural land in Vinh city, the land price adjustment coefficient is K=1.3; in Cua Lo town, Hoang Mai town, Thai Hoa town, Nghi Loc district, Dien Chau district, Yen Thanh district, Quynh Luu district, Do Luong district, Nam Dan district, Hung Nguyen district, Nghia Dan district, Thanh Chuong district, Anh Son district, Quy Hop district, Tan Ky district, the land price adjustment coefficient is K=1.2; in Ky Son district, Tuong Duong district, Que Phong district, Quy Chau district, Con Cuong district, the land price adjustment coefficient is K=1.1.

Particularly for investment projects on construction and business of infrastructure of industrial parks in the Southeast Economic Zone, investment projects on construction and business of infrastructure of industrial parks established by the Government in the province, the land price adjustment coefficient for non-agricultural land is K=1.

The Provincial People's Council assigned the People's Committee of Nghe An province to organize the implementation of the Resolution and Decision, and announce the land price adjustment coefficient in accordance with regulations.

Regarding this content, previously, Vice Chairman of the Provincial People's Committee Nguyen Van De signed Decision No. 03/2024/QD-UBND dated February 5 promulgating the land price adjustment coefficient in 2024 in the province.

The land price adjustment coefficient (K) is applied to determine land use fees and land rents for land plots or areas with a value (calculated according to the land price in the Land Price List) of less than VND 20 billion, in the following cases: Organizations are allocated land by the State with land use fees collected without auctioning land use rights, recognizing land use rights, and allowing change of land use purposes; Households and individuals are allocated land by the State without auctioning land use rights; Households and individuals are recognized by the State with land use rights, and allowed to change land use purposes for residential land areas exceeding the limit.

At the same time,   Determining the unit price of land lease with annual land rent payment for cases of land lease for business, trade, services, real estate, mineral exploitation purposes; Determining the unit price of land lease with one-time payment for the entire lease term without auction; Determining the unit price of land lease with annual land rent payment to land lease with one-time payment for the entire lease term according to regulations; Determining the unit price of land lease when receiving the transfer of assets attached to leased land according to regulations; Determining the unit price of land lease with annual land rent payment and the unit price of land lease with one-time payment for the entire lease term when equitizing state-owned enterprises; Determining the starting price in land use right auctions for land allocation with land use fee collection, land lease with one-time land rent payment for the entire lease term.

Determine the unit price of land lease with annual land rent payment for the next stable period for land plots or land areas leased by the State for commercial, service, real estate, and mineral exploitation purposes with a value (calculated according to the land price in the Land Price List) of VND 20 billion or more. Determine the unit price of land lease with annual land rent payment (excluding cases of land lease for commercial, service, real estate, and mineral exploitation purposes). Determine the starting price in the auction of land use rights for lease in the form of land lease with annual land rent payment. Determine land use fees and land rents in Economic Zones according to the provisions of Decree No. 35/2017/ND-CP dated April 3, 2017 of the Government regulating the collection of land use fees, land rents, and water surface rents in Economic Zones and High-tech Zones. Other cases must apply the land price adjustment coefficient according to the provisions of law.

This Decision takes effect from February 15, 2024 and replaces Decision No. 63/2022/QD-UBND dated December 23, 2022 of the Provincial People's Committee on promulgating the land price adjustment coefficient in 2023 in the province.
