Perfecting institutions to improve the quality of judicial work
Through discussion, National Assembly deputies expressed their agreement and appreciation for the reports; stating that the workload of the Public Security, People's Court, People's Procuracy, Government Inspectorate and Ministry of Justice all increased, but the implementation results all met and exceeded the targets set by the National Assembly, showing great efforts of the sectors.
Security, order and social safety are maintained, ensuring a favorable environment for socio-economic development. Many loopholes in social and economic management have been discovered and corrected, the awareness of law observance of the whole society has been raised, and people have confidence in the fight against crime.

In order for the judicial work to achieve more results, National Assembly deputies suggested that reports should include more recommendations to improve institutions, especially the legal system. The National Assembly and the Government need to have appropriate mechanisms and policies for judicial agencies and appropriate remuneration for officials and civil servants in the judicial sector, in accordance with the quantity, nature of work, and development area.
Delegate Nguyen Thi Ngoc Xuan (Binh Duong) said that in recent years, reports from the two agencies, the People's Court and the Procuracy, have mentioned difficulties in terms of staffing, inadequate financial arrangements, many pressures, and inability to ensure the implementation of tasks, but these have not been resolved yet. Therefore, the delegate expressed concern about the current staffing situation and the demand for positions and jobs, including positions and jobs in judicial titles and positions and jobs in administration, information technology, and digital data management in the entire sector, the situation of judicial officials quitting their jobs, etc.
Believing that drug crimes are becoming extremely complicated, delegate Nguyen Huu Thong (Binh Thuan) cited the illegal use of drugs, especially synthetic drugs, at conditional business establishments, accommodation services... occurring in many localities, with the appearance of some types of drugs disguised as electronic cigarettes, drinks, and food, causing multi-faceted harm to users, especially young people. From the above situation, the delegate suggested that the Government and ministries and branches need to assess and propose fundamental solutions to resolve and prevent this type of crime in the coming time.

Assessing the fight against corruption and negativity, which is receiving attention from the Party and State and has achieved certain results, some delegates emphasized that the fight against corruption and negativity in judicial activities is an issue of great concern to the National Assembly, voters, and public opinion.
Delegate Siu Huong (Gia Lai) suggested that it is necessary to take strong measures to deal with violations of the law in the judicial sector, protect the law, contribute to protecting the regime and legitimate rights of subjects; and further strengthen the work of educating public ethics.
Suggesting solutions to overcome shortcomings and limitations in judicial work
At the end of the session, the Chief Justice of the Supreme People's Court, the Chief Prosecutor of the Supreme People's Procuracy, the Minister of Public Security, and the Government Inspector General spoke to explain and clarify a number of issues raised by National Assembly deputies.
Minister of Public Security To Lam expressed that with the huge amount of work that the authorities have to deal with in 2023, spanning many areas of social life, it is inevitable that there will still be shortcomings and limitations.
The Minister clarified the causes of the shortcomings and limitations. Firstly, the group of causes belongs to the subjective nature of the competent authorities such as the problem of implementing solutions to prevent and combat crimes and law violations; violations in investigating and handling crimes; coordination between competent authorities; spirit and responsibility in performing tasks, with some individual cases of violations, negativity and law violations. Secondly, the difficulties and obstacles in terms of law, policies and mechanisms as stated in the report. Thirdly, the difficulties in resources in performing the task of preventing and combating crimes and law violations.
According to the Minister of Public Security, some of the above-mentioned shortcomings, difficulties and problems can be resolved immediately, but others will take time. Therefore, the Government and the Ministry of Public Security will accept the opinions and recommendations of the National Assembly deputies to continue to promote the implementation of crime prevention and control, contributing to building a healthy, orderly and disciplined society, ensuring a peaceful, happy and safe life for the people.
Receiving the opinions of the National Assembly delegates, Chief Justice of the Supreme People's Procuracy Le Minh Tri explained the concerns: why is it that the more we fight and combat crime, the more law violations and crimes increase?
According to the Director, there are many causes for this problem. “Paying attention, valuing and focusing on prevention work to proactively prevent it in a timely manner is one of the solutions to prevent crime from the root. The solutions proposed by some National Assembly deputies also clearly state that prevention work must be strengthened. I think that prevention work is related to both law-making work and the synchronous participation of the political system and the social community... Only then will our fight be more effective,” Director Le Minh Tri stated.

Chief Justice of the Supreme People's Court Nguyen Hoa Binh said that the majority of opinions of National Assembly deputies agreed with the reports, highly appreciated the efforts of the agencies, and affirmed the results achieved in 2023. Thereby, the situation of law violations was controlled, justice was ensured, the investment environment was favorable and open, and the peaceful life of the people was preserved.
The opinions pointed out some shortcomings, shared the difficulties of the agencies conducting the proceedings, and proposed solutions to overcome the shortcomings and limitations. Many delegates mentioned difficulties such as the shortage of funding and staff, incentive regimes, and suggested that the National Assembly include them in the Resolution of the session to increase resources for the agencies conducting the proceedings.
Regarding the summary of trial practice, regarding the proposal to amend a number of articles of the Criminal Code, Chief Justice Nguyen Hoa Binh said that the Court will summarize and report to the National Assembly according to its authority. Regarding the time of determining damages, when drafting Resolution 03/2020/NQ-HDTP guiding the application of a number of provisions of the 2015 Penal Code in the trial of corruption crimes and other crimes related to positions, the Court sought opinions from all agencies and followed the same procedure as the law-making process. This Resolution clearly stated the time of law application.
Clarifying some key issues that delegates were interested in, Government Inspector General Doan Hong Phong said that regarding the building and perfecting of anti-corruption institutions, in recent times, the Government and the Prime Minister have focused on leading and directing the improvement of the quality of law-making and perfecting work, in order to prevent corruption, negativity, and group interests.
In particular, the Government has issued a Resolution on a number of solutions to improve the quality of work in building and perfecting the legal system and organizing law enforcement; the Prime Minister has directed ministries, branches and localities to strengthen the work of inspecting, reviewing, amending and supplementing policies and laws, and overcoming loopholes and inadequacies that can easily be exploited for corruption.
However, the work of building and perfecting institutions is still limited, the situation of slow issuance of detailed documents has not been completely overcome, and there are still overlaps in the legal system.

The Government Inspector General said that he will work with ministries and branches to advise the Government and the Prime Minister to continue to promote and improve the work of building and perfecting institutions, in order to gradually perfect the prevention mechanism, making it impossible to commit corruption; at the same time, strictly implement the Party's regulations on controlling power, preventing and combating corruption and negativity in inspection, supervision, auditing, investigation, prosecution, trial, and execution of judgments, in order to prevent and combat corruption and negativity within functional agencies.
