On the afternoon of March 9, at the National Assembly House, Politburo member and National Assembly Chairman Vuong Dinh Hue chaired a working session to give initial opinions on receiving and explaining opinions of National Assembly deputies and issues arising during the process of collecting public opinions on the draft Land Law (amended).
Attending the meeting were members of the Party Central Committee: Vice Chairman of the National Assembly Nguyen Duc Hai, Vice Chairman of the National Assembly Nguyen Khac Dinh; Secretary General of the National Assembly, Chairman of the National Assembly Office Bui Van Cuong; Chairman of the Economic Committee Vu Hong Thanh; Chairman of the Law Committee Hoang Thanh Tung; Vice Chairmen, Standing Members, Full-time Members of the Economic Committee of the National Assembly, Permanent Representatives of the Ethnic Council and Committees of the National Assembly, leaders of units under the National Assembly Office.
Also attending the meeting were Deputy Prime Minister Tran Hong Ha; Deputy Minister of Natural Resources and Environment Le Minh Ngan; leaders of the following agencies: Ministry of Justice; Government Office; Central Committee of the Vietnam Fatherland Front; and representatives of relevant agencies.

Speaking at the opening of the working session, National Assembly Chairman Vuong Dinh Hue said that according to the schedule, at the legal thematic session in April 2023, the National Assembly Standing Committee will give opinions on the draft Land Law (amended) and submit it to the National Assembly for a second discussion on this Law project at the 5th Session (May 2023).
On the other hand, the process of collecting public opinions on the draft Land Law (amended) will end on March 15. Currently, the organization of collecting public opinions is taking place actively across the country, recording many valuable contributions from relevant stakeholders and subjects.
The National Assembly Chairman emphasized that, in the spirit of early preparation from afar, at the request of the National Assembly's Economic Committee and the Ministry of Natural Resources and Environment, this working session aims to listen to reports and give initial opinions on the situation of explanation, reception of opinions of National Assembly deputies and the collection of public opinions, thereby providing a basis for the drafting agency and the reviewing agency to continue perfecting the draft Law and related reports to submit to the National Assembly Standing Committee and the National Assembly.
At the meeting, delegates listened to Deputy Minister of Natural Resources and Environment Le Minh Ngan report on the progress of the implementation of the Land Law project (amended); the review, reception and explanation of opinions of National Assembly deputies; and issues arising through the process of collecting public opinions.

Deputy Minister of Natural Resources and Environment Le Minh Ngan said that in the past time, implementing Resolution No. 671/NQ-UBTVQH15 of the National Assembly Standing Committee on organizing the collection of public opinions on the draft Land Law (amended) and Resolution No. 170/NQ-CP of the Government on the Plan for organizing the collection of public opinions on the draft Land Law (amended), the collection of public opinions on the draft Land Law was truly a broad political and social activity, attracting the attention of many classes of people, intellectuals, Vietnamese people residing abroad, organizations and enterprises operating in Vietnam. The propaganda and dissemination work of media agencies was carried out regularly, continuously and widely throughout the country to every village, hamlet, neighborhood and people..., many newspapers and magazines opened columns for people to contribute opinions on the contents of the draft Law.
Through synthesizing comments from agencies, organizations and individuals, many opinions agreed with the basic contents of the draft Law, assessing that the draft has many innovations, meeting the needs and aspirations of the people, promoting land resources for socio-economic development, contributing to strict land management, economical and effective land use. Comments focused on groups of contents on land recovery, compensation, support and resettlement policies; land finance mechanisms and policies, land prices; commercialization of annual land lease rights and selection of land rent payment methods; regimes and management of land use; public land, land with underground works and the right to use space above ground; the role of the Front and its members; the role of the People's Committees at the commune level; land allocation, land lease, land use purpose conversion, land fund development; Land registration, issuance of Certificates and administrative procedures, land data and information; land use planning and plans; decentralization, supervision and control of power; households using land; handling of Laws that conflict or overlap with the draft Land Law (amended).

Also at the conference, delegates listened to the initial summary of comments on the draft Land Law (amended) from the National Assembly's Economic Committee and the Vietnam Fatherland Front. Chairman of the Economic Committee Vu Hong Thanh said that after the deadline of March 15, which is the last day to collect public opinions on the draft Land Law (amended), agencies, ministries, branches and localities will synthesize comments and send many reports to the Ministry of Natural Resources and Environment - the drafting agency. Synthesizing a large volume of content poses many challenges as well as pressure to transfer documents to the National Assembly agencies to submit to the National Assembly Standing Committee in early April 2023 as planned. This requires agencies to resolutely direct implementation to ensure progress and requirements.
Recalling the conclusion of the National Assembly Standing Committee on this content, it is necessary to closely follow and fully institutionalize the guidelines, orientations and policies in the documents of the 13th Party Congress, Resolution No. 18-NQ/TW dated June 16, 2022 of the 5th Conference of the 13th Party Central Committee, noting that only issues that are ripe, clear enough and have been decided by the Central Committee should be specified; issues that are not clear enough, mature enough, and have not been concluded by the Central Committee should not be included in the draft Law, Chairman of the Economic Committee Vu Hong Thanh suggested that there should be a further report on the difficulties in institutionalizing the Resolution or issues that have been institutionalized but still have different opinions. It is recommended that in addition to synthesizing the opinions of the People, the Government and the Ministry of Natural Resources and Environment should pay attention to clarifying the contents of explanations and receptions, especially the opinions of National Assembly deputies at the 4th Session of the 15th National Assembly.

Moderating the discussion, National Assembly Chairman Vuong Dinh Hue noted that the data from collecting public opinions is very large. Therefore, without a scientific approach, it will be difficult to synthesize and absorb effectively.
The National Assembly Chairman said that through monitoring the comments on the law, there were many specific opinions and recommendations on the interpretation of terms. Therefore, agencies need to have a separate section on this content to clarify concepts, unify understanding and implementation. In addition, there are regulations related to the role of the State, clarifying the role of the representative of the entire people's land ownership, performing the function of State management and being a land user; the role of the commune-level government; a group of planning issues, the relationship between planning and planning, solving land issues in regional planning and provincial, district and commune planning; solving the differences between the Law on Planning and the Law on Land; the issue of planning adjustment, adjustment of agricultural land planning, planning adjustment authority; on land recovery and conversion of land use purposes of households; the issue of land recovery to ensure the rights of citizens while ensuring feasibility; a group of issues on transfer, lease, mortgage; Land finance issues, land price lists, land prices close to market prices, whether or not to legalize regulations on land price maps; ensuring compatibility between laws, minimizing the assignment of detailed regulations... Pointing out that these are the contents that have received many comments, the National Assembly Chairman suggested that agencies need to distinguish groups of issues to have plans to receive and explain; note that reviewing the contents and issues that have been concluded by the Central Government, do not discuss them again, to avoid further complicating the issue. The process of receiving and amending the Law must listen to and closely follow the reality of life, the National Assembly Chairman emphasized.

Discussing at the working session, Vice Chairman of the National Assembly Nguyen Khac Dinh stated that the end of this public opinion collection period does not mean that there will be no more public opinion collection on the draft Law, but that there will continue to be a channel to widely receive public opinions both domestically and internationally, and to continue to listen, study, absorb and explain the contents of the comments on the Law until the National Assembly considers and approves it in accordance with the provisions of Article 57 of the Law on Promulgation of Legal Documents.
Vice Chairman of the National Assembly Nguyen Khac Dinh also suggested that in the process of synthesizing opinions, in addition to stating the group of issues, agencies need to analyze the nature of the problem, the plan to receive it, and state the social trends of which content has many comments, which content has few comments, which content has many different comments, and the opinions of different groups of people, businesses, and management agencies to have a solution;... There are comments outside the draft Law that, after research and synthesis, can be reported to competent authorities for consideration and acceptance.

Acknowledging the interest of all classes of people, target groups, businesses, scientists, and the role of the press and media in collecting public opinions on the draft Land Law (amended), Vice Chairman of the National Assembly Nguyen Duc Hai requested a general assessment of the results of organizing the collection of public opinions, while emphasizing the responsibility of comprehensive synthesis, timely reception, and explanation of relevant agencies.
According to Vice Chairman of the National Assembly Nguyen Duc Hai, the synthesis needs to be analyzed from many different aspects, because each group of subjects is interested in certain groups of issues such as through the channel of collecting opinions from the Fatherland Front, people are interested in land prices, compensation and resettlement support, land recovery, land rights; the group of scientists is interested in pricing methods, land relations; the group of enterprises is interested in exercising rights, land policies, paying land rent, land lease terms.
Vice Chairman of the National Assembly Nguyen Duc Hai also requested that the agencies of the National Assembly uphold their sense of responsibility and initiative, not wait for the end of the consultation process or wait for the Government's report to be sent before considering and giving opinions, but should promptly study the issue to have opinions on the plan to receive and explain.

Deputy Prime Minister Tran Hong Ha said that in the past time, implementing the Resolutions of the National Assembly and the Government, thoroughly grasping the direction of the National Assembly Chairman, the collection of opinions has been seriously implemented, closely following the progress, methods, requirements, content groups, organizing in-depth collection of opinions according to groups of experts, businesses, regional representatives... along with inspection and supervision of the implementation. Deputy Prime Minister Tran Hong Ha stated that in this process, there has always been the accompaniment of the National Assembly with the Government. Important conferences and seminars organized by Government agencies have all had the participation of National Assembly leaders, representatives of National Assembly agencies and vice versa. In addition, National Assembly agencies have also proactively organized the collection of opinions independently and objectively.
Receiving the opinions at the working session, Deputy Prime Minister Tran Hong Ha added that the contents mentioned by the National Assembly Chairman are the contents that have received many comments, including issues that are difficult to institutionalize, or difficult to implement, or have many different opinions. Therefore, in the coming time, the agencies of the National Assembly and the Government need to continue to discuss and clarify; emphasizing that this is a common product regardless of the National Assembly agency, the Government agency, the important thing is to orient the handling, the agencies need to give specific comments, discuss and debate together to come up with the optimal solution.
Regarding issues with many problems and different opinions such as land planning, land valuation, land for mountainous people, Deputy Prime Minister Tran Hong Ha suggested that it is necessary to organize a number of conferences to invite specific experts on those issues to help solve current challenges and choose the most optimal solution.

Deputy Prime Minister Tran Hong Ha expressed his confidence that with the current implementation method, with the early support from the National Assembly and the consensus of the entire system, no matter how difficult the problem is, it will be completed, and the agencies will have complete information to reach conclusions on issues with different opinions.
Deputy Prime Minister Tran Hong Ha also affirmed that the collection of public opinions must continue until the National Assembly passes the law; research and acceptance must be conducted continuously in the most serious and scientific spirit.
Concluding the working session, National Assembly Chairman Vuong Dinh Hue stated that through the discussion, the work of collecting public opinions has been actively responded to and implemented throughout the country, demonstrating the interest of all levels, sectors, sectors and the entire population in this very important Law project. The National Assembly Chairman highly appreciated the Government, together with relevant agencies of both the Government and the National Assembly, the Vietnam Fatherland Front and its member organizations, all levels and sectors for their efforts in collecting opinions on the law-making process. From there, many profound and specific contributions were received, many valuable opinions, in addition to opinions of principles, viewpoints and orientations, there were also many specific comments on each clause with full scientific and practical basis.

The National Assembly Chairman said that there is not much time left until the end of the public consultation period and the agencies complete the summary report, requiring more urgent efforts in the spirit of conducting it as a campaign regardless of day or night, trying to coordinate agencies without distinguishing roles; at the same time, he noted that progress is important but quality is more important.
The National Assembly Chairman requested that agencies conduct synthesis to study and have a plan to absorb and explain; discuss together how to do it, synthesize opinions with a high sense of responsibility, honesty, objectivity, impartiality, respect all opinions, clarify the bad and bring out the good, not let any opinion go unsynthesized, no opinion go unexplained; synthesize comprehensively and completely, choose major key issues to synthesize and evaluate, choose important issues with different opinions to continue to organize research to collect opinions and discuss in more depth and detail.
