Encroachment and sale of tens of thousands of square meters of public land in Bao Loc City

On February 5, a source from Nguoi Lao Dong Newspaper reported that the People's Committee of Bao Loc City (Lam Dong Province) had issued a document assigning relevant units to study the contents related to the handling of land plot No. 171, map sheet No. 9, Loc Tien Ward with an area of ​​over 75,000 m2.

Rent land and leave it abandoned

According to research, land plot number 171 in Loc Tien ward is state-managed land but was encroached upon by many people and then transferred by hand to others.

Initially, this land was managed by the People's Committee of Loc Tien commune according to the cadastral map established in 1986, and later by Loc Tien ward with the cadastral map established in 1995. The authorities of Lam Dong province and Bao Loc city have inspected and confirmed that the origin of the land plot is public land managed by the state.

In 2003, the land was leased by Lam Dong Province to Lam Dong Construction Materials Company (now Lam Dong Minerals and Construction Materials Joint Stock Company) as a waste dump for a period of 20 years. However, from the time of lease until 2011, Lam Dong Construction Materials Company did not use the land, so many people gradually encroached on the land. In 2012, the company sent trucks to dump the waste, but the encroaching people prevented them from dumping it.

According to the authorities, the Provincial People's Committee leased the land but for a long time Lam Dong Construction Materials Company did not use it, there was no management of the leased land, leading to people encroaching, using and then arbitrarily transferring this land to each other by handwritten papers.

The reason given is that after the decision to lease, the relevant parties have not yet developed a compensation plan for land clearance for households using the land. Therefore, households and individuals with land here still cultivate, manage, and transfer land by hand. At the same time, the leased land has no clear boundary, leading to cases where adjacent land has encroached on the land.

In 2019, Lam Dong Provincial People's Committee issued a decision to reclaim land plot No. 171 leased to Lam Dong Minerals and Construction Materials Joint Stock Company, and assigned Bao Loc City People's Committee to manage an area of ​​more than 75,000 m2 of land plot No. 171.

Dispute arises

According to the verification of the authorities of Bao Loc City, the use of land at plot 171 of the state is continuous. The encroaching households do not have papers or documents proving the right to use land on plot 171, so the transfer by hand in this land is against the law.

However, during the transfer process, the transferees knew that this was state-managed land, without a land use right certificate, but still agreed to the transfer, so there was no sign of "fraudulent appropriation of property".

According to the reporter's records, there are about 20 households and individuals using land plot 171; land use is quite complicated when land boundaries are unclear and disputes arise.

In 2020, authorities noted that a number of gangs regularly gathered in this area related to land use, forcing the People's Committee of Loc Tien Ward to establish a 24/7 task force in the area to limit the emergence of security and order hotspots. Some households then submitted a petition to issue a land use right certificate for the land belonging to plot No. 171, but the People's Committee of Bao Loc City has not yet considered it.

In the state management of this land plot, Bao Loc City People's Committee has repeatedly directed Loc Tien Ward People's Committee to inspect, verify and handle violations against households that encroached in 2018, 2020 and 2021, but as of July 2024, the Ward People's Committee has not yet handled administrative violations in these cases. Therefore, the Chairman of Bao Loc City People's Committee at that time, Mr. Nguyen Van Phuong, criticized Loc Tien Ward People's Committee for being slow to implement the direction of the city leaders.

Up to now, the authorities have recommended that the Chairman of Bao Loc City People's Committee should issue a document requesting Lam Dong Provincial People's Committee to direct relevant units to measure the current status, determine boundaries, and adjust changes in cadastral maps according to regulations for land plot No. 171 to serve the settlement of complaints.

Consider management responsibilities

The authorities of Lam Dong province requested the Chairman of Bao Loc City People's Committee to review the responsibility of the Chairman, Vice Chairman, and officers in charge of land and construction of Loc Tien Ward People's Committee through the periods in the leadership and direction of the implementation of state management of land, allowing the illegal transfer of land use rights, construction of houses and works on the area of ​​land plot No. 171 managed by the state according to regulations. Up to the time the authorities verified this incident, Bao Loc City People's Committee and Loc Tien Ward People's Committee had not handled any administrative violations related to the cases of encroachment and use of land plot No. 171 of public origin managed by the state.
