Both sellers and buyers do not know the regulations

In many cases, consumers in the province are confused about where to complain when their rights are violated. Ms. Nguyen Hoang Hoa (My Thach Bac block, Tan Thanh ward, Tam Ky city) said that she recently bought a bottle of foreign wine from a store in Tam Ky to treat guests. Unfortunately, she bought poor quality wine but did not know where to start, even when reporting to the store.

When asked about the Law on Consumer Protection, many people do not understand the relevant regulations. Ms. Tran Hoai Huong - an office worker at a business company in Tam Ky City said that she hardly knows much about the Law on Consumer Protection. She also encountered some cases of buying fake, poor quality goods online but did not know how to report it.

The current direct shopping habit of most consumers in the province is to look at the goods, pay for them and then receive them, rarely caring about getting an invoice or asking for a warranty. When buying goods that are not guaranteed in quality, or goods that are defective or counterfeit, there is no protection.

Mostly, people only reflect and negotiate with the sales establishments, and whether the store allows exchange, return, repair, or warranty depends on the reputation, conscience, and responsibility of the seller. Consumers have no basis to force the seller to fulfill responsibility for product quality.

According to Mr. Nguyen Van Dung - Vice President of the Quang Nam Consumer Rights Protection Association, the association's members all work part-time, often spending most of their time focusing on professional work at their units, so they rarely participate in general work.

In June, the Quang Nam Consumer Protection Association was supposed to hold a congress to elect a new executive committee to more effectively manage consumer protection work, but for many reasons it was postponed without a plan to hold it.

According to our research, the current Chairman of the Quang Nam Consumer Rights Protection Association is Mr. Nguyen Hong Van - former Director of the Department of Industry and Trade.

Mr. Van has been retired for many years and is living in Da Nang City. A member of the Quang Nam Consumer Rights Protection Association said that the association has had almost no activities in recent times.

Join hands to protect consumers

Mr. Luong Viet Tinh - Director of the Quang Nam Market Management Department said that in October, the functional sector conducted 62 inspections of goods trading in the provincial market. The number of cases pending processing was 3; the number of cases processed was 23; the total amount of money collected to the budget after processing was 317 million VND. The violations were trading in smuggled goods, counterfeit goods, goods that do not ensure food safety, etc.

According to Mr. Luong Viet Tinh, in the current market, products with high profit potential are at risk of being counterfeited. Counterfeit and fake goods appear everywhere and are increasingly diverse, from daily consumer goods, cigarettes to machinery, equipment, fertilizers, pesticides, functional foods, shoes, and fashion products.

Even anti-counterfeit stamps, which are a way to protect businesses, goods and consumers, are counterfeited. The way for consumers to identify fake and genuine goods to avoid confusion when shopping is also confused today.

“We continue to step up inspection of goods trading in the province to prevent counterfeit goods, smuggled goods, and goods that do not ensure quality to stabilize the market and protect the legitimate rights of consumers, promoting socio-economic development,” said Mr. Tinh.

Recently, the Government issued Decree No. 55 detailing a number of articles of the Law on Consumer Protection. Ms. Vu Thi Thanh Nga - Head of Tam Ky Market Management Board said that based on the decree, the Market Management Board issued regulations with contents on protecting consumer rights, including the rights and responsibilities of consumers and sellers; people responsible for receiving and resolving requests and complaints from consumers and measures to handle violations. Reconciliation of disputes between consumers and sellers.

Maintain the operation of balance scales and measuring devices for consumers to self-check the quantity and weight of goods. The Market Management Board regularly monitors the quality and quantity of goods; establishes and publicly posts a hotline to receive and resolve consumer requests in accordance with the law.

The Ministry of Industry and Trade has just issued a plan to organize activities in response to Vietnam Consumer Rights Day 2025. The Ministry of Industry and Trade requires state agencies to strengthen market monitoring and inspection activities; step up propaganda, dissemination, reception and settlement of complaints and requests from consumers; and resolutely and strictly handle acts that infringe upon the legitimate rights and interests of consumers.
