Documents and procedures for registering a tutoring business

(Dan Tri) - Circular 29 of the Ministry of Education and Training (MOET) stipulates that organizations and individuals organizing extra-curricular teaching outside of school must register their business in accordance with the law.

Procedures for registering a tutoring business in the form of individual household business registration are carried out at the district-level business registration agency, the Department of Finance and Planning.

Accordingly, the registration dossier for tutoring business includes the following documents: Application for business registration; personal legal documents for the business owner or family member registering the business.

In case household members register a business household, the dossier must include a copy of the minutes of the household members' meeting on the establishment of the business household and a copy of the household members' authorization document for one member to be the business owner.

Applications can be submitted in person or online, processing time is 3 working days.

In case a teacher wants to open a tutoring center, the application procedures are carried out according to the provisions of the Enterprise Law on business registration.

Depending on the type of center owned by an individual or many people contributing capital, whether there is foreign investment or not, and the type of business, the documents and procedures will be different.

Procedures for opening a tutoring center are carried out at the business registration office of the Department of Planning and Investment of the province where the center's headquarters is located.

Teachers need to note some important points when registering a tutoring business or establishing a tutoring center according to Circular 29.

Specifically, public school teachers are not allowed to participate in the management and operation of extra-curricular teaching.

Besides, according to the Enterprise Law, civil servants and public employees are not allowed to establish and manage enterprises.

Combining these two regulations, teachers at public schools are not allowed to register their own private tutoring business, are not allowed to register their own business, and are not allowed to participate in the management and operation of tutoring outside of school in the form of hired labor.

Public school teachers are only allowed to teach extra classes for centers and individuals with legal tutoring business papers.

However, private school teachers are not bound by the above regulations.

In addition, all teachers, whether public or private, who participate in extra-curricular teaching outside of school for any form of payment, including working for tutoring centers, are not allowed to teach students in regular classes.

At the same time, tutoring businesses and tutoring centers are not allowed to tutor primary school students, except for teaching artistic talents, sports, and life skills.
