Pursuant to Circular No. 05/2021/TT-BNV dated September 1, 2021 of the Minister of Home Affairs guiding the functions, tasks and powers of the Department of Home Affairs, on November 16, 2023, the People's Committee of Nghe An province issued Decision No. 32/2023/QD-UBND stipulating the functions, tasks, powers and organizational structure of the Department of Home Affairs.
At the district-level People's Committee, up to now, 21/21 units of the District-level Department of Home Affairs have issued the functions, tasks and powers of the Department of Home Affairs in accordance with the guidance of Circular No. 05/2021/TT-BNV. Regarding the work of inspection, review and systematization of legal documents in the field of Home Affairs, every year, the Provincial People's Committee issues a Plan on the work of inspection, review and systematization of legal documents in the province and organizes full inspection.
From 2020 to February 2024, the Provincial People's Council and People's Committee issued 12 legal documents in the field of internal affairs (2 Resolutions, 10 Decisions). Through inspection, it was discovered that 1 legal document issued by the District People's Committee was inconsistent with current legal regulations. Inspecting documents sent by agencies and individuals issuing documents and when there were recommendations from agencies and organizations, the Department of Justice discovered 2 documents with illegal content.
After the inspection, the Department of Justice coordinated with the Department of Home Affairs to request the unit to issue the document to conduct a self-inspection and propose a handling direction according to the provisions of the law. Up to now, 1 document has been abolished according to regulations, 1 document is being coordinated by the issuing agency to handle.
At the same time, local Party committees and authorities have paid attention to leadership, direction, and budget allocation for judicial activities in general, especially the activities of drafting, inspecting, and handling legal documents. District-level units have been more proactive in conducting self-inspection, handling, and reporting results to inspection agencies according to regulations, especially in handling documents with content that is not in accordance with legal regulations according to recommendations of inspection agencies.
In the past time, the Provincial People's Committee has directed the full implementation of legal regulations, Directives and Resolutions of the Central Committee on emulation and commendation work; document and archive work; State management of youth; compliance with legal regulations on the establishment of organizational apparatus, payroll, payroll spirit at administrative organizations and public service units.
In addition, the province has also issued documents guiding and urging departments, branches and localities to implement the above contents.
During the discussion at the meeting, delegates focused on exchanging legal documents related to the field of internal affairs such as: Law enforcement situation, self-monitoring, inspection, and handling of legal documents, difficulties and inadequacies in handling, reviewing, and systematizing documents in the field of internal affairs...
Speaking at the meeting, Permanent Vice Chairman of the Provincial People's Committee Le Hong Vinh emphasized that in recent times, Nghe An has basically carried out the work of checking legal documents quite regularly, which is considered a key and priority task. The province has strictly implemented the provisions of the law, but there are still some legal provisions that are slow to be implemented.
According to the Standing Vice Chairman of the Provincial People's Committee, through this inspection by the Ministry of Home Affairs, the province will have an opportunity to re-evaluate the results achieved, and at the same time, correct the shortcomings and limitations in the implementation of legal regulations related to the Home Affairs sector.
Comrade Le Hong Vinh also requested the Department of Home Affairs to take the lead in connecting and coordinating with relevant agencies to prepare documents and explain the contents of the delegation's concerns. The Department of Home Affairs will receive comments from the delegation members to complete the report.
Concluding the meeting, Mr. Vu Chien Thang - Deputy Minister of Home Affairs acknowledged and highly appreciated the results achieved in the work of building, perfecting and enforcing laws in the field of home affairs. At the same time, he requested the Department of Home Affairs to re-prepare reports and appendices for submission to the inspection team.
As planned, the inspection team will conduct a field inspection at a number of agencies and units in Nghe An province tomorrow (April 12).
